This final sessi<strong>on</strong> is known as the closing joint sessi<strong>on</strong>. 33<br />

2.38 The parties are not bound by any positi<strong>on</strong>s taken during a mediati<strong>on</strong><br />

until a final agreement is reached and signed, at which point it becomes an<br />

enforceable c<strong>on</strong>tract. Mediati<strong>on</strong> aims to achieve a ‗win-win‘ result for the parties<br />

to a dispute. Some of the proclaimed advantages of mediati<strong>on</strong> include: speed,<br />

privacy, cost, flexibility, informality, party-c<strong>on</strong>trol, and preservati<strong>on</strong> of<br />

relati<strong>on</strong>ships.<br />

2.39 Several varieties of mediati<strong>on</strong> have been developed. Shuttle<br />

mediati<strong>on</strong> is a form of mediati<strong>on</strong> where the mediator goes between the parties<br />

and assists them in reaching an agreement without meeting "face to face". 34<br />

Transformative mediati<strong>on</strong> does not seek resoluti<strong>on</strong> of the immediate problem,<br />

but rather, seeks the empowerment and mutual recogniti<strong>on</strong> of the parties<br />

involved. 35 Therapeutic mediati<strong>on</strong> is an assessment and treatment approach<br />

that assists families in dealing with emoti<strong>on</strong>al issues in high c<strong>on</strong>flict separati<strong>on</strong><br />

and divorce. The focus is <strong>on</strong> the parties themselves as opposed to the<br />
