Pensi<strong>on</strong>s – what entitlements are there and how will they be<br />

distributed?<br />

Assets – how will the couple divide their assets?<br />

Debts – how will they manage debts and other outgoings?<br />

C<strong>on</strong>tents of the family home – how will the c<strong>on</strong>tents be allocated? 47<br />

5.40 Prop<strong>on</strong>ents of family mediati<strong>on</strong> argue that the traditi<strong>on</strong>al adversarial<br />

litigati<strong>on</strong> system is unable to adapt to the needs unique to family breakdown.<br />

Where human relati<strong>on</strong>ships are strained, the adversarial approach may actually<br />

increase rather than reduce c<strong>on</strong>flict. 48 ―The basic nature of the adversarial<br />

system pits parents against each other, encourages polarised and positi<strong>on</strong>al<br />

thinking, and discourages parental communicati<strong>on</strong>, cooperati<strong>on</strong>, and more<br />

mature thinking about children‘s needs at a critical time of change and<br />

upheaval.‖ 49<br />

5.41 In its <str<strong>on</strong>g>C<strong>on</strong>sultati<strong>on</strong></str<strong>on</strong>g> <str<strong>on</strong>g>Paper</str<strong>on</strong>g> <strong>on</strong> Family Courts, 50 the Commissi<strong>on</strong><br />

acknowledged a number of advantages and disadvantages for mediati<strong>on</strong>. The<br />

Commissi<strong>on</strong> noted that the advantages that have been put forward for<br />

mediati<strong>on</strong> as an alternative to the adversarial process include:<br />

Adversarial court hearings may exacerbate the fricti<strong>on</strong> and hostility<br />

inherent in most marital disputes, while the emphasis in mediati<strong>on</strong> is<br />

rather <strong>on</strong> fostering co-operati<strong>on</strong> and establishing workable<br />

arrangements for the future;<br />
