(9) The main focus of the <str<strong>on</strong>g>C<strong>on</strong>sultati<strong>on</strong></str<strong>on</strong>g> <str<strong>on</strong>g>Paper</str<strong>on</strong>g><br />
15. The Commissi<strong>on</strong> notes, therefore, that ADR, in the sense just<br />
discussed, can be said to encompass a very wide area of law and legal<br />
processes. In this respect, the Commissi<strong>on</strong> c<strong>on</strong>sidered that, to provide as full<br />
an analysis as possible of ADR, it was necessary to provide an overview of the<br />
applicati<strong>on</strong> of ADR in these different settings. In some places, the <str<strong>on</strong>g>C<strong>on</strong>sultati<strong>on</strong></str<strong>on</strong>g><br />
<str<strong>on</strong>g>Paper</str<strong>on</strong>g> provides a general overview of ADR processes in a specific setting by<br />
way of describing their l<strong>on</strong>g-standing use – this is the case in the discussi<strong>on</strong> of<br />
employment disputes and ADR. 16 In that area of its use, the Commissi<strong>on</strong> does<br />
not make any specific suggesti<strong>on</strong>s for reform, for the simple reas<strong>on</strong> that those<br />
engaged in using ADR in that setting – notably the Labour Relati<strong>on</strong>s<br />
Commissi<strong>on</strong> – are fully c<strong>on</strong>scious of the need to develop and refine their ADR<br />
processes. Similarly, while the Commissi<strong>on</strong> refers in the <str<strong>on</strong>g>C<strong>on</strong>sultati<strong>on</strong></str<strong>on</strong>g> <str<strong>on</strong>g>Paper</str<strong>on</strong>g> to<br />
the use of arbitrati<strong>on</strong> as an alternative to litigati<strong>on</strong>, it is clear that the future<br />
development of this l<strong>on</strong>g-established area of dispute resoluti<strong>on</strong> will be debated<br />
in the Oireachtas in the immediate future 17 and that it would therefore be<br />
inappropriate to make reform proposals <strong>on</strong> arbitrati<strong>on</strong> in the <str<strong>on</strong>g>C<strong>on</strong>sultati<strong>on</strong></str<strong>on</strong>g> <str<strong>on</strong>g>Paper</str<strong>on</strong>g>.<br />
16. The Commissi<strong>on</strong>‘s main focus in the <str<strong>on</strong>g>C<strong>on</strong>sultati<strong>on</strong></str<strong>on</strong>g> <str<strong>on</strong>g>Paper</str<strong>on</strong>g> can,<br />
therefore, be divided into three areas in respect of which it makes provisi<strong>on</strong>al<br />
recommendati<strong>on</strong>s and, where relevant, invites views and submissi<strong>on</strong>s <strong>on</strong> ADR.<br />
First, the Commissi<strong>on</strong> examines the terminology associated with ADR, in<br />
particular the need for a c<strong>on</strong>sistent definiti<strong>on</strong> of mediati<strong>on</strong> and c<strong>on</strong>ciliati<strong>on</strong>, and<br />
the underlying general principles c<strong>on</strong>cerning ADR processes. The purpose of<br />
this is to seek to achieve c<strong>on</strong>sistency in the use of terminology surrounding<br />
ADR and the key underlying principles. The sec<strong>on</strong>d area of focus is <strong>on</strong> the<br />
applicati<strong>on</strong> of ADR in specific areas, including family law disputes, commercial<br />
disputes and property disputes. The purpose here is to address more specific<br />
matters in these settings which the Commissi<strong>on</strong> c<strong>on</strong>siders may be in need of<br />
further clarificati<strong>on</strong> or development. The third area c<strong>on</strong>cerns the training and<br />
regulati<strong>on</strong> of ADR professi<strong>on</strong>als. The Commissi<strong>on</strong> regards this as a vital aspect<br />
of ensuring the quality of justice likely to be achieved through ADR.<br />

17. Having described its general approach to alternative dispute<br />
resoluti<strong>on</strong>, the Commissi<strong>on</strong> turns to provide a brief outline of each Chapter in<br />
the <str<strong>on</strong>g>C<strong>on</strong>sultati<strong>on</strong></str<strong>on</strong>g> <str<strong>on</strong>g>Paper</str<strong>on</strong>g>.<br />
