25. In Chapter 8, the Commissi<strong>on</strong> examines the development of ADR in<br />

resolving c<strong>on</strong>sumer disputes. The Commissi<strong>on</strong> examines, for example, whether<br />

the Small Claims Court procedure could be expanded to resolve more<br />

c<strong>on</strong>sumer disputes.<br />

26. In Chapter 9, the Commissi<strong>on</strong> explores the potential role for ADR in<br />

the resoluti<strong>on</strong> of specific types of property disputes, in particular between<br />

neighbours. The Commissi<strong>on</strong> c<strong>on</strong>siders whether ADR has any role to play in<br />

the resoluti<strong>on</strong> of planning applicati<strong>on</strong> disputes.<br />

27. In Chapter 10, the Commissi<strong>on</strong> addresses the accreditati<strong>on</strong> and<br />

regulati<strong>on</strong> of mediators and the various n<strong>on</strong>-statutory and statutory schemes for<br />

assuring the quality of mediators.<br />

28. In Chapter 11, the Commissi<strong>on</strong> examines the role of the Court in the<br />

development of ADR. The Commissi<strong>on</strong> explores the issue of costs sancti<strong>on</strong>s<br />

and mediati<strong>on</strong> and the precise manner in which mediators report back to the<br />

Courts. The Commissi<strong>on</strong> also c<strong>on</strong>siders whether mediati<strong>on</strong> costs should be<br />

recoverable as legal costs.<br />

29. Chapter 12 c<strong>on</strong>tains the provisi<strong>on</strong>al recommendati<strong>on</strong>s made by the<br />

Commissi<strong>on</strong> in the <str<strong>on</strong>g>C<strong>on</strong>sultati<strong>on</strong></str<strong>on</strong>g> <str<strong>on</strong>g>Paper</str<strong>on</strong>g>.<br />

30. This <str<strong>on</strong>g>C<strong>on</strong>sultati<strong>on</strong></str<strong>on</strong>g> <str<strong>on</strong>g>Paper</str<strong>on</strong>g> is intended to form the basis of discussi<strong>on</strong><br />

and therefore all the recommendati<strong>on</strong>s made are provisi<strong>on</strong>al in nature. The<br />

Commissi<strong>on</strong> will make its final recommendati<strong>on</strong>s <strong>on</strong> ADR following further<br />

c<strong>on</strong>siderati<strong>on</strong> of the issues and c<strong>on</strong>sultati<strong>on</strong> with interested parties.<br />

Submissi<strong>on</strong>s <strong>on</strong> the provisi<strong>on</strong>al recommendati<strong>on</strong>s included in this <str<strong>on</strong>g>C<strong>on</strong>sultati<strong>on</strong></str<strong>on</strong>g><br />

<str<strong>on</strong>g>Paper</str<strong>on</strong>g> are welcome. To enable the Commissi<strong>on</strong> to proceed with the preparati<strong>on</strong><br />

of its Final Report, those who wish to do so are requested to make their<br />

submissi<strong>on</strong>s in writing by post to the Commissi<strong>on</strong> or by email to<br />
