c<strong>on</strong>sumer disputes. 64 The 1998 recommendati<strong>on</strong> c<strong>on</strong>tains 7 principles, namely:<br />

independence of the dispute settlement body to ensure the impartiality<br />

of its acti<strong>on</strong>s;<br />

transparency of the scheme to ensure that the c<strong>on</strong>sumer has all the<br />

necessary informati<strong>on</strong> about the procedure and that the results<br />

obtained can be objectively assessed;<br />

adversarial procedure to ensure that the c<strong>on</strong>sumer has the possibility<br />

to present all their views and are informed about the arguments of the<br />

other party;<br />

effectiveness of the procedure to ensure that the c<strong>on</strong>sumer will benefit<br />

from the advantages of an alternative dispute settlement, including:<br />

access without being obliged to use a legal representative; a procedure<br />

that is free of charge or of moderate cost and swift; and an active role<br />

of the dispute settlement body enabling it to take into c<strong>on</strong>siderati<strong>on</strong> any<br />

factors c<strong>on</strong>ducive to a settlement of the dispute;<br />

legality to guarantee that the decisi<strong>on</strong> taken by the dispute settlement<br />

body does not deprive the c<strong>on</strong>sumer of the protecti<strong>on</strong> afforded by the<br />

relevant c<strong>on</strong>sumer protecti<strong>on</strong> legislati<strong>on</strong>;<br />

liberty to ensure that the decisi<strong>on</strong> taken may be binding <strong>on</strong> the<br />

c<strong>on</strong>sumer <strong>on</strong>ly if they are informed of its binding nature in advance and<br />

specifically accept this after the dispute in questi<strong>on</strong> has arisen; and<br />

representati<strong>on</strong> to ensure that the c<strong>on</strong>sumer has the possibility to be<br />

represented in the procedure by a third party if they wish. 65<br />

8.39 Governments of EC Member States were asked to notify the<br />

European Commissi<strong>on</strong> of out-of-court dispute settlement bodies in their State<br />
