8.52 Similarly, Forfás recommended in its 2002 report Legislating for<br />

Competitive Advantage in e-Business and Informati<strong>on</strong> & Communicati<strong>on</strong>s<br />

Technologies that the Government should assess the possible role of an <strong>on</strong>line<br />

ombudsman in providing a c<strong>on</strong>ciliati<strong>on</strong> service between c<strong>on</strong>sumers and firms<br />

trading over the Internet and in adjudicating any disputes arising. The Report<br />

also recommended that if the Irish Courts are to operate as an effective<br />

mechanism for the appeal and review of e-ADR, the electr<strong>on</strong>ic systems used<br />

would have to be integrated or shared. It also stated that mechanisms by which<br />

the <strong>on</strong>line ADR and the e-Courts could be integrated, building up<strong>on</strong> the 27th<br />

Interim Report of the Committee <strong>on</strong> Court Practice and Procedure. 92<br />

8.53 The Commissi<strong>on</strong> is also aware of the <strong>on</strong>going work of the Courts<br />

Service in its development of an eCourts strategy 93 and invites submissi<strong>on</strong>s <strong>on</strong><br />

how the 2002 Reports <strong>on</strong> <strong>on</strong>line dispute resoluti<strong>on</strong> can be further developed.<br />

8.54 The Commissi<strong>on</strong> commends the recommendati<strong>on</strong>s <strong>on</strong> <strong>on</strong>line dispute<br />

resoluti<strong>on</strong> of c<strong>on</strong>sumer disputes made by the Informati<strong>on</strong> Society Commissi<strong>on</strong><br />

in its 2002 Report Building Trust and by Forfas in its 2002 Report Legislating for<br />

Competitive Advantage in e-Business and Informati<strong>on</strong> & Communicati<strong>on</strong>s<br />

Technologies and invites submissi<strong>on</strong>s as to whether they should be<br />

incorporated into a statutory Code of Practice c<strong>on</strong>cerning mediati<strong>on</strong> and<br />

c<strong>on</strong>ciliati<strong>on</strong> in c<strong>on</strong>sumer disputes.<br />

F Small Claims Court<br />

8.55 Since its incepti<strong>on</strong> as a pilot scheme in 1991 the Small Claims Court,<br />

which operates in the District Court, has become an invaluable tool in allowing<br />

c<strong>on</strong>sumers to assert their c<strong>on</strong>sumer rights. 94 The success of this scheme led to<br />

the establishment of the procedure nati<strong>on</strong>wide 1993. The main advantage of the<br />

procedure from the c<strong>on</strong>sumer perspective is that their <strong>on</strong>ly liability in terms of<br />
