a. Report on <strong>the</strong> Participation <strong>of</strong> <strong>the</strong> States <strong>in</strong> Relevant Treaties Concern<strong>in</strong>g<br />

<strong>International</strong> Humanitarian Law and its National Implementation<br />

Victims <strong>of</strong> armed conflicts<br />

<strong>International</strong> humanitarian law protects persons who do not<br />

or no longer take part <strong>in</strong> <strong>the</strong> hostilities. It also limits <strong>the</strong> means<br />

and methods <strong>of</strong> warfare. The pr<strong>in</strong>cipal rules <strong>of</strong> <strong>in</strong>ternational<br />

humanitarian law are set down <strong>in</strong> <strong>the</strong> four 1949 Geneva<br />

Conventions and <strong>the</strong>ir two Additional Protocols <strong>of</strong> 1977.<br />

1. Participation <strong>in</strong> Relevant treaties<br />

1949 Geneva Conventions<br />

The four Geneva Conventions,<br />

which are <strong>the</strong> most widely accepted<br />

<strong>in</strong>ternational treaties, have been<br />

ratified by all 194 States.<br />

Each <strong>of</strong> <strong>the</strong> four Geneva Conventions<br />

protects a specific category <strong>of</strong><br />

victims <strong>of</strong> <strong>in</strong>ternational armed conflicts,<br />

i.e., those armed conflicts <strong>in</strong><br />

which two or more States take part:<br />

• The First Convention protects <strong>the</strong><br />

sick and wounded <strong>of</strong> armed forces<br />

<strong>in</strong> <strong>the</strong> battlefield;<br />

• <strong>the</strong> Second Convention protects<br />

<strong>the</strong> sick, wounded and shipwrecked<br />

<strong>of</strong> armed forces at sea;<br />

• <strong>the</strong> Third Convention protects<br />

prisoners <strong>of</strong> war;<br />

• <strong>the</strong> Fourth Convention protects civilians<br />

<strong>in</strong> <strong>the</strong> hands <strong>of</strong> an adverse power.<br />

In addition, all four Conventions<br />

conta<strong>in</strong> a common Article 3, which<br />

protects victims <strong>of</strong> non-<strong>in</strong>ternational<br />

armed conflicts.<br />

The Geneva Conventions have been<br />

supplemented by three Additional<br />

Protocols.<br />

1977 Additional Protocol I<br />

19 Additional Protocol I also applies<br />

<strong>in</strong> <strong>in</strong>ternational armed conflicts,<br />

<strong>in</strong>clud<strong>in</strong>g armed conflicts <strong>in</strong><br />

which peoples <strong>in</strong> <strong>the</strong> exercise <strong>of</strong><br />

<strong>the</strong>ir right <strong>of</strong> self-determ<strong>in</strong>ation<br />

are fight<strong>in</strong>g aga<strong>in</strong>st colonial dom<strong>in</strong>ation,<br />

alien occupation and racist<br />

regimes. This <strong>in</strong>strument, besides<br />

develop<strong>in</strong>g <strong>the</strong> applicable law to<br />

protect victims <strong>of</strong> armed conflicts,<br />

sets down fundamental rules concern<strong>in</strong>g<br />

<strong>the</strong> conduct <strong>of</strong> hostilities.<br />

Additional Protocol I has been ratified<br />

by 1 States, 33 <strong>of</strong> which are<br />

American. Two American States<br />

have not ratified it yet.<br />

1977 Additional Protocol II<br />

19 Additional Protocol II develops<br />

and supplements common Article<br />

3 <strong>of</strong> <strong>the</strong> Geneva Conventions.<br />

It is <strong>the</strong> only treaty whose sole purpose<br />

is to regulate <strong>the</strong> protection <strong>of</strong><br />

victims <strong>of</strong> non-<strong>in</strong>ternational armed<br />

conflicts.<br />

Additional Protocol II has been ratified<br />

by 1 2 States, 32 <strong>of</strong> which are<br />

American. Three American States<br />

have not ratified it yet.<br />
