Nowadays, <strong>the</strong> number <strong>of</strong> States Parties<br />

to this treaty has risen to 102, 23<br />

<strong>of</strong> which are American. It is worth<br />

mention<strong>in</strong>g that Sa<strong>in</strong>t Kitts and<br />

Nevis deposited <strong>the</strong> <strong>in</strong>strument <strong>of</strong><br />

ratification on August 22nd, 200 .<br />

1968 Convention on <strong>the</strong> Non-<br />

Applicability <strong>of</strong> Statutory<br />

Limitations to War Crimes and<br />

Crimes aga<strong>in</strong>st Humanity<br />

The 19 Convention on <strong>the</strong> Non-<br />

Applicability <strong>of</strong> Statutory Limitations<br />

to War Crimes and Crimes<br />

aga<strong>in</strong>st Humanity is ano<strong>the</strong>r tool to<br />

streng<strong>the</strong>n <strong>the</strong> system <strong>of</strong> repression<br />

<strong>of</strong> war crimes. This Convention encompasses<br />

<strong>the</strong> statutory limitations<br />

to both public action and penalties<br />

and it is retroactive, as it requires<br />

exist<strong>in</strong>g limitations established by<br />

o<strong>the</strong>r laws or rules to be abolished.<br />

There are 49 States which are Parties<br />

to <strong>the</strong> Convention on <strong>the</strong> Non-Applicability<br />

<strong>of</strong> Statutory Limitations<br />

to War Crimes and Crimes aga<strong>in</strong>st<br />

Humanity. In <strong>the</strong> Americas, States<br />

have ratified this treaty. The number<br />

<strong>of</strong> ratifications has rema<strong>in</strong>ed unchanged<br />

<strong>in</strong> this region dur<strong>in</strong>g 200 .<br />

2000 Optional Protocol to <strong>the</strong><br />

Convention on <strong>the</strong> Rights <strong>of</strong><br />

<strong>the</strong> Child on <strong>the</strong> Involvement <strong>of</strong><br />

Children <strong>in</strong> Armed Conflict<br />

The Optional Protocol to <strong>the</strong> Convention<br />

on <strong>the</strong> Rights <strong>of</strong> <strong>the</strong> Child<br />

seeks to prevent any person under<br />

<strong>the</strong> age <strong>of</strong> 1 from be<strong>in</strong>g recruited<br />

to participate <strong>in</strong> an armed conflict.<br />

The Optional Protocol has been ratified<br />

by a total <strong>of</strong> 110 States, twentytwo<br />

<strong>of</strong> <strong>the</strong>m from <strong>the</strong> Americas.<br />

2. National Implementation <strong>of</strong><br />

Relevant Treaties<br />

War Crimes<br />

Each <strong>of</strong> <strong>the</strong> four 1949 Geneva Conventions<br />

conta<strong>in</strong>s a provision whereby<br />

States Parties undertake to adopt<br />

all necessary measures to punish<br />

persons who have committed or ordered<br />

<strong>the</strong> commission <strong>of</strong> any grave<br />

breach <strong>of</strong> said Conventions.<br />

Fur<strong>the</strong>rmore, <strong>the</strong>y establish that<br />

each State must search for <strong>in</strong>dividuals<br />

accused <strong>of</strong> hav<strong>in</strong>g committed or<br />

ordered <strong>the</strong> commission <strong>of</strong> serious<br />

breaches, regardless <strong>of</strong> <strong>the</strong>ir nationality,<br />

<strong>in</strong> order to have <strong>the</strong>m appear<br />

before <strong>the</strong> States’ own courts.<br />

At <strong>the</strong>ir discretion, and pursuant<br />

to <strong>the</strong>ir own legal provisions, <strong>the</strong><br />

States can transfer such <strong>in</strong>dividuals<br />

to ano<strong>the</strong>r State for trial as long<br />

as <strong>the</strong> latter has pressed sufficient<br />

charges aga<strong>in</strong>st <strong>the</strong>se <strong>in</strong>dividuals.<br />

more particularly Part V, Section II<br />

<strong>the</strong>re<strong>of</strong>, supplements <strong>the</strong>se regulations<br />

by stipulat<strong>in</strong>g that <strong>the</strong> provisions<br />

<strong>of</strong> <strong>the</strong> Conventions relat<strong>in</strong>g to<br />

<strong>the</strong> repression <strong>of</strong> breaches shall apply<br />

to <strong>the</strong> rules set forth <strong>in</strong> <strong>the</strong> Protocol.<br />

Thus, <strong>the</strong> Protocol develops<br />

<strong>the</strong> rules stipulated by <strong>the</strong> Geneva<br />

Conventions as regards <strong>the</strong> specification<br />

<strong>of</strong> breaches <strong>of</strong> <strong>in</strong>ternational<br />

humanitarian law, commission <strong>of</strong><br />
