estudios sobre el razonamiento práctico, la lógica, la inteligencia artificial,
la filosofía de la acción, la filosofía de la ciencia, la filosofía de
la religión, la epistemología, la filosofía del lenguaje, la teoría de la
argumentación, la filosofía de la mente, entre otros 12 . En la teoría del
derecho este término fue introducido por H.L.A. Hart en 1948 en el
artículo «The ascription of responsibility and rights», quien la utilizó a
efectos de presentar un concepto que, según él, no existía una expresión
que le haga referencia. Dicho en extrema síntesis, incorporó el término
para señalar que la satisfacción de las condiciones de aplicación de un
concepto no es suficiente para garantizar su aplicación. Lo hizo en los
siguientes términos:
«When the student has learnt that in English law there are positive conditions
required for the existence of a valid contract (…) his understanding of
the legal concept of a contract is still incomplete (…). For these conditions,
although necessary, are not always sufficient and he has still to learn what can
defeat a claim that there is a valid contract, even though all these conditions
are satisfied. That is the student has still to learn what can follow on the
word ‘unless’ which should accompany the statement of these conditions. This
characteristic of legal concepts is one for which no word exists in ordinary
English. The words ‘conditional’ and ‘negative’ have the wrong implications,
but the law has a word which with some hesitation I borrow and extend:
this is the word ‘defeasible’ used of a legal interest in property which is
subject to termination or ‘defeat’ in a number of different contingencies but
remains intact if no such contingencies mature. In this sense then, contract
is a defeasible concept» 13 .
Aquel artículo de Hart fue el primer antecedente de lo que Pierluigi
Chiassoni ha llamado, con acierto, el giro derrotabilista en el pensamiento
jurídico contemporáneo 14 . En efecto, desde aquella publicación
