ABSTRACT<br />
The main purpose of this work is to bring to the academic debate the reality of the Brazilian<br />
prison system ahead forecasts contained in the Penal Execution Law, doing an analysis of being<br />
and the system should be, in this case an approach between reality and normative forecast.Today<br />
the failure of the Brazilian prison system is very clear, the daily media so blatant<br />
and shameless, it provides materials, presenting to society the ominous reality of the system,<br />
inmates live in subhuman conditions because the prisons are true deposits of human beings,<br />
overcrowding leads to sexual violence among inmates, proliferating severe diseases, the<br />
stronger subordinate the weaker, drugs are increasingly seized inside the cells, riots occur routinely,<br />
and in these, convicts are killed by their own colleagues, employees and families detainees<br />
are transformed into hostages and besides daring escapes and rescues occur like in a movie,<br />
corruption is so scary, and even worse, there is the factor of the infiltration of criminal<br />
gangs inside the prison, where brazen Mentors continue to <strong>com</strong>mand criminal actions. In this<br />
context what is most striking is the human capacity to adapt to chaos, where the indifference<br />
exacerbates the problem, society has be<strong>com</strong>e accustomed to this sad reality of failure and disruption,<br />
so has no courage to take measures of governments and even realizes that the Brazilian<br />
legal framework has a law with wonderful predictions regarding the management of the<br />
prison system, however unfortunately, it needs more effectiveness. In this sense, this monograph<br />
addresses the topic in question, making a <strong>com</strong>parison between reality (being) and forecasts<br />
contained in the legislation (should be), starting with historical features of criminal law<br />
and criminal enforcement, reaching a peak with a <strong>com</strong>parative analysis of the prison system<br />
with the Law Enforcement criminal case that they need urgent changes to the system because<br />
the prisons be<strong>com</strong>e real "universities of crime".We must invest in building new prisons, as<br />
well as in a wide legal, medical, psychological and social assistence, with the creation and expansion<br />
of projects aiming at the prisoner's work as a way to banish idleness, primary duty<br />
must be separated from recidivists, the reintegration to the social life must be planned to offer<br />
to the inmates real guarantees of returning to the job market, and other measures that are necessary<br />
interms of remediation. But above all, we need investment in the structure of society<br />
itself, and this is done through serious and effective educational projects in search of crime<br />
prevention, because this effect is consistent with the well-known by Pythagoras asserted: "educate<br />
the children so that is not necessary to punish the adults."<br />
