CONTRACTING PARTIES TO THE CONVENTION FOR THE PREVENTION OF MARINE<br />

POLLUTION FROM LAND-BASED SOURCES AGREE:<br />

To prevent <strong>PCB</strong>s and hazardous <strong>PCB</strong> substitutes from entering the marine environment and to this end they<br />

shall:<br />

1. take measures to phase out and to destroy in an environmentally safe manner all identifiable <strong>PCB</strong>s as<br />

soon as possible with the aim of complete destruction, including the interim options of safe deep<br />

underground disposal in dry rock formation of capacitors and empty transformers, ensuring that the time<br />

between taking out of service and destruction is as short as practicable:<br />

a. by 1995, or by the end of 1999 at the latest, for Iceland and the Contracting Parties which are<br />

riparian to the North Sea;<br />

b. by 2005, or by the end of 2010 at the latest, for the remaining Contracting Parties.<br />

2. take measures to phase out and to destroy in an environmentally safe manner hazardous <strong>PCB</strong> substitutes<br />

in use with the aim of complete destruction, including the interim options of safe deep underground<br />

disposal in dry rock formation of capacitors and empty transformers, ensuring that the time between<br />

taking out of service and destruction is as short as practicable:<br />

a within seven years, at the latest, after their identification for Iceland and the Contracting Parties<br />

which are riparian to the North Sea 2 2;<br />

b. between identification date and the year 2010 or between identification date and seven years<br />

later, whichever date is later for the remaining Contracting Parties.<br />

3. take measures in order to prevent or strictly control the use of hazardous <strong>PCB</strong> substitutes in capacitors<br />

and transformers.<br />

This decision supersedes PARCOM Decision 90/4 on the phasing out of <strong>PCB</strong>s.<br />

1 In the context of this Decision hazardous <strong>PCB</strong> substitutes are defined as "persistent, bioaccumulative organic<br />

compounds with hazard or structure characteristics comparable to those revealed by <strong>PCB</strong>s". In assessing the<br />

hazardous character of the proposed <strong>PCB</strong> substitutes Contracting Parties shall take account of the Guidelines for<br />

Environmental Risk Assessment Scheme annexed to this Decision.<br />

2 With regard to France, this Decision applies to the area covered by the Convention.
