to wymagało. Na razie, 3 sierpnia, Rada Ministrów przyjęła
uchwałę nr 89 w sprawie ustanowienia programu wieloletniego
„Wyposażenie Sił Zbrojnych Rzeczypospolitej Polskiej
w czołgi” i zapewnienia warunków jego realizacji, w którego
ramach miałyby zostać pozyskane Abramsy. Ma być on realizowany
w latach 2021–2026 (do 31 grudnia 2026 r.) i objąć: wyposażenie
SZ RP w czołgi, pakiet szkoleniowy i logistyczny oraz
środki bojowe; szkolenie personelu, przygotowanie infrastruktury
oraz sfinansowanie wydatków związanych z wyborem
określonego rodzaju (sic!) i amunicji. Potwierdza ona, że program
będzie finansowany ze środków budżetu państwa, które
nie są wliczane do limitu wydatków obronnych na podstawie
art. 7 ustawy z 25 maja 2001 r. o przebudowie i modernizacji
technicznej SZ RP lub ze środków Funduszu Modernizacji Sił
Zbrojnych albo z innych źródeł. Wydatki te nie mogą w latach
2021–2026 przekroczyć kwoty 4,8 mld PLN rocznie. Środki niewykorzystane
w jednym roku przechodzą na lata następne.
Nie podano dotąd żadnych szczegółowych informacji dotyczących
procesu decyzyjnego, którego efektem jest zainicjowanie
procedury zakupu czołgów w Stanach Zjednoczonych,
a także o trybie zakupu. Wiadomo jedynie, że wiosną tego roku
w Stanach Zjednoczonych przebywała w tym celu grupa rekonesansowa
polskich oficerów z Inspektorem Wojsk Lądowych
gen. dyw. Maciejem Jabłońskim na czele, a decyzja o zakupie
Abramsów to wynik tzw. pilnej potrzeby operacyjnej.
Jeśli chodzi o podjęte kroki formalne związane z procedurą
zakupu, także 14 lipca minister Mariusz Błaszczak poinformował
o skierowaniu do amerykańskiej administracji federalnej
zapytania ofertowego (Letter of Request, LoR) w sprawie zakupu
czołgów wraz z pakietem towarzyszącym. Jest to pierwszy
formalny etap zakupu sprzętu wojskowego w ramach
procedury Foreign Military Sales (FMS). Na podstawie zapytania
Departamenty Stanu i Obrony wydadzą (lub nie) zgodę
na ewentualną sprzedaż czołgów wraz z pakietami modernizacyjnymi
do Polski. Jeśli zgoda zostanie wyrażona, Agencja
ds. Bezpieczeństwa Współpracy Obronnej (DSCA, Defense Security
Cooperation Agency) prześle stosowny wniosek do Kongresu
Stanów Zjednoczonych w celu notyfikacji. To umożliwi
zainicjowanie ostatecznych negocjacji cenowych i sformułowanie
projektu umowy międzyrządowej pomiędzy Stanami
Zjednoczonymi a Polską (Letter of Offer and Acceptance,
LOA). Cała ta procedura zajmie z pewnością kilka miesięcy, jeśli

For now, on August 3, the Council of Ministers adopted
the resolution No. 89 on establishing a multi-annual programme
‘Equipping the Polish Armed Forces with tanks’ and ensuring the
conditions for its implementation, under which Abrams MBTs
would be obtained. The programme is to be implemented
in the years 2021–2026 (until December 31, 2026) and it will
include equipping the Polish Armed Forces with tanks, training
and logistics packages as well as ammunition; staff training,
infrastructure preparation and financing of expenses related
to the selection of a specific type (sic!) and ammunition. The
resolution confirms that the programme will be financed from
the state budget funds, which are not included in the limit of defence
expenditures pursuant to Art. 7 of the Act of May 25, 2001
on the reconstruction and technical modernisation of the Polish
Armed Forces or from the Armed Forces Modernisation Fund
or other sources. These expenses may not exceed PLN 4.8 billion
per year in the years 2021–2026. Funds not used in one year are
transferred to the following years.
So far, no detailed information has been provided on the
decision-making process, in result of which is to initiate the purchase
procedure for tanks in the United States, as well as on the
purchase procedure. It is only known that in the spring of this
year, a recointer group of Polish officers with from the Inspector
of Land Forces Maj. Gen. Maciej Jabłoński at the forefront,
visited the U.S. and that the decision to buy Abrams MBTs is the
result of the so-called urgent operational need.
As for the formal steps taken related to the purchase procedure,
also on July 14, Minister Błaszczak announced that
a Letter of Request (LoR) was sent to the U.S. federal administration
regarding the purchase of tanks with an accompanying
package. This is the first formal stage of purchasing military
equipment under the Foreign Military Sales (FMS) procedure.
On the basis of the inquiry, the Departments of State and Defence
will (or not) grant consent to the possible sale of tanks
along with modernisation packages to Poland. If consent
is given, the Defense Security Cooperation Agency (DSCA) will
send the appropriate request to the U.S. Congress for notification.
This will enable the initiation of final price negotiations
and the formulation of a draft intergovernmental agreement
between the United States and Poland (Letter of Offer and
Acceptance, LOA). The entire procedure will certainly take
