KEY SECTION: A permit is required from the Department of Minerals and Energy for any mining,<br />
quarrying or other extractive activities. This is in addition to any permits required under<br />

KEY SECTIONS: The National Environmental Management Act (NEMA) is the first step in giving legal effect<br />
to the environmental rights in the Constitution (Section 24).<br />
THE ACT: Establishes principles to guide the decisions and actions of all organs of state<br />
(NEMA Principles);<br />
Establishes procedures for co-operative governance;<br />
Promotes integrated environmental management by establishing procedures for<br />
environmental impact assessments and enabling any national or provincial<br />
permitting authority to prescribe environmental impact assessment regulations<br />
Of key importance is Section 5, which deals with Environmental Impact Assessment<br />
(EIA) and Environmental Management Frameworks (EMFs). EIA regulations have been<br />
promulgated in terms of Section 5 of NEMA. Development activities must have<br />
environmental authorisation from the relevant environmental authority (namely DALA)<br />
before commencement. In addition, the Province can compile information and maps<br />
in the form of EMFs which will inform the EIA process by identifying environmental<br />
attributes (such as environmental sensitivity, biodiversity, etc. ) for a specific geographic<br />
area. The EMFs will also guide spatial planning for the affected geographic area. EMFs<br />
can be compiled for a local municipal area.<br />
