III. TEMPORARY DIRECT PAYMENTS MEASURES FOR CROATIA<br />

The reimbursement of direct payments granted to farmers for <strong>the</strong> year 2013 shall be conditional on<br />

<strong>the</strong> application by <strong>Croatia</strong>, before accession, of rules identical to those set out for such direct<br />

payments in Council Regulation (EC) 73/2009 of 19 January 2009 establishing common rules for<br />

direct support schemes for farmers under <strong>the</strong> common agricultural policy <strong>and</strong> establishing certain<br />

support schemes for farmers, amending Regulations (EC) No 1290/2005, (EC) No 247/2006, (EC)<br />

No 378/2007 <strong>and</strong> repealing Regulation (EC) No 1782/2003 1 , <strong>and</strong> in Commission Regulations (EC)<br />

No 1120/2009, (EC) No 1121/2009 <strong>and</strong> (EC) No 1122/2009 2 .<br />

I. LAYING HENS<br />

5. FOOD SAFETY, VETERINARY AND PHYTOSANITARY POLICY<br />

31999 L 0074: Council Directive 1999/74/EC of 19 July 1999 laying down minimum st<strong>and</strong>ards for<br />

<strong>the</strong> protection of laying hens (OJ L 203, 3.8.1999, p. 53).<br />

By way of derogation from Article 6 of Council Directive 1999/74//EC, laying hens in lay at <strong>the</strong><br />

date of accession may be kept in cages which are not in conformity with <strong>the</strong> structural requirements<br />

laid down in that Article. <strong>Croatia</strong> shall ensure that <strong>the</strong> use of such cages stops at <strong>the</strong> latest 12<br />

months after accession.<br />

<strong>the</strong> direct support schemes for farmers provided for that Regulation, as well as for <strong>the</strong><br />

implementation of Council Regulation (EC) No 1234/2007 as regards cross-compliance under <strong>the</strong><br />

support scheme provided for <strong>the</strong> wine sector (OJ L 316, 2.12.2009, p. 1, 27 <strong>and</strong> 65).<br />
