II. SUPPLEMENTARY PROTECTION CERTIFICATES<br />

1. 31996 R 1610: Regulation (EC) No 1610/96 of <strong>the</strong> European Parliament <strong>and</strong> of <strong>the</strong> Council of<br />

23 July 1996 concerning <strong>the</strong> creation of a supplementary protection certificate for plant<br />

protection products (OJ L 198, 8.8.1996, p. 30).<br />

(a) The following point is added to Article 19a:<br />

'(m) any plant protection product protected by a valid basic patent <strong>and</strong> for which <strong>the</strong> first<br />

authorisation to place it on <strong>the</strong> market as a plant protection product was obtained after<br />

1 January 2003 may be granted a certificate in <strong>Croatia</strong>, provided that <strong>the</strong> application for<br />

a certificate is lodged within six months of <strong>the</strong> date of accession.'<br />

(b) Article 20(2) is replaced by <strong>the</strong> following:<br />

'2. This Regulation shall apply to supplementary protection certificates granted in accordance<br />

with <strong>the</strong> national legislation of <strong>the</strong> Czech Republic, Estonia, <strong>Croatia</strong>, Cyprus, Latvia,<br />

Lithuania, Malta, Pol<strong>and</strong>, Romania, Slovenia <strong>and</strong> Slovakia prior to <strong>the</strong>ir respective date of<br />

accession.'<br />

2. 32009 R 0469: Regulation (EC) No 469/2009 of <strong>the</strong> European Parliament <strong>and</strong> of <strong>the</strong><br />

Council of 6 May 2009 concerning <strong>the</strong> supplementary protection certificate for medicinal<br />

products (OJ L 152, 16.6.2009, p. 1).<br />

(a) The following point is added to Article 20:<br />

'(m) any medicinal product protected by a valid basic patent <strong>and</strong> for which <strong>the</strong> first<br />

authorisation to place it on <strong>the</strong> market as a medicinal product was obtained after 1<br />

January 2003 may be granted a certificate in <strong>Croatia</strong>, provided that <strong>the</strong> application for a<br />

certificate is lodged within six months of <strong>the</strong> date of accession.'<br />
