5.5.7 No interest will be paid for the EMD submitted.
5.5.8 The EMD will be forfeited, if an offerer;
5.5.8.1 Misrepresents facts or submit false / fake documents during the
EOI process.
5.5.8.2 If the offerer willfully violates any terms and conditions of the EOI
documents.
5.5.8.3 If the offerer withdraws its bid after the opening of EOI
document.
5.5.8.4 A successful offerer fails to sign the contract after issuance of
Letter Of Intent.
5.5.8.5. Fails to furnish performance security after issuance of Letter Of
Intent.
5.5.8.6. If the EOI offer is rejected on the basis of the non satisfactory
inspection report of the Quality control facilities of the firm.
5.6 Period of Validity of EOI
5.6.1 The offers must remain valid for two years. An offer for a shorter period
shall be rejected by the Corporation as non-responsive.
5.6.2 Withdrawal or non-compliance of agreed terms and conditions after the
execution of agreement will lead to invoking of penal provisions and may
also lead to black listing / debarring of the successful offerer as per the
procedure detailed in clause 5.34, for a period upto 3 years, immediately
succeeding the EOI agreement year and the offerer will be ineligible to
participate in any of the empanelment / tender of the Corporation for a
period upto 3 year.
5.7 Pre Offer Meeting
5.7.1 Date of pre-offer meeting is mentioned in Section III.
5.7.2 Pre-offer meeting is called by the Corporation to explain briefly about the
requirements as well as the terms and conditions of the EOI document and
to get the views of the prospective offerers, as part of ensuring
transparency in the EOI process.
5.7.3 It is an opportunity for the prospective offerer to obtain all the details about
the offered items, conditions governing the offer and also to get the
explanation of any ambiguous condition that may be present in the EOI
document.
