5.13 Modification and Withdrawal of EOI offer 5.13.1 The offerer may modify or withdraw its offer, after the EOI submission, provided that written notice of the modification or withdrawal is received by the Corporation before the date opening of the EOI. 5.13.2 The offerers’ modification or withdrawal notice shall be signed by the offerer or his / her authorized representative, who have signed the original EOI documents. A withdrawal notice may also be sent by fax or email but should necessarily be followed by a signed confirmation copy to be received at the head office of the Corporation before the date of opening of the technical document. 5.13.3 No bid may be withdrawn in the interval after the opening of EOI and the finalization of the EOI. Withdrawal of an EOI during this interval will result in the forfeiture of its EMD and shall lead to black listing of the offerer for a period upto 3 years immediately succeeding the offer year and the offerer shall be ineligible to participate in any of the offers / tenders of the Corporation for a period of 3 years. 5.14 Opening of EOI 5.14.1 The opening of the EOI offer shall be done by the Corporation or his authorized representative in the presence of the prospective offerers or his/her representative who choose to attend at the respective time and place mentioned in Section III. 5.14.2 The offerers or representatives present for the opening of the envelopes shall sign registers evidencing their attendances. 5.14.3 In the event of the specified date for opening of EOI being declared holiday, the EOI shall be opened at the appointed time and venue on the next working day. 5.14.4 The offerer’s names, the presence or absence of the requisite EMD and such other details as the Corporation may consider appropriate, shall be announced at the time of opening of the EOI. 5.14.5 In the event of the offer and claims in the cover are materially missing or of substantial error or unqualified for want of required qualifications, shall stand disqualified and rejected. However, minor infirmities in the submission of documents will be allowed to be rectified so as to ensure qualification of maximum number of offerers to the final round. 5.14.6 The offerer shall be responsible for properly superscribing and sealing the envelopes and the Corporation shall not be held liable for accidental KMSCL: EOI for Empanelment of Drug testing Laboratories Page 17
opening of the envelopes before the time appointed for opening of the offers. 5.14.7 The final list of eligible empanelled labs will be published only after the conclusion of Inspection of laboratory facilities. 5.14.8 Scanned copies of the key documents such as Approved license, Annual turnover statement, NABL accreditation, Details of testing facilities, List of Drugs / items other certification offered to be tested submitted by the offerers as part of the offer will be published in the website of the Corporation immediately after opening of the offer as part of transparency of the Corporation. These documents must be submitted in CD’s also. 5.15 Evaluation of EOI 5.15.1 The documents submitted as part of the offer shall be scrutinized by an EOI Evaluation Committee constituted by the EOI Inviting Authority. 5.15.2 The findings of the Document Evaluation Committee on whether the offers are responsive or non-responsive or requiring clarifications will be published on the website. 5.15.3 The inspection of the Drugs testing facilities of those firms which has not been inspected during the past years and that of the new participants shall be conducted by a team of experts. The check list for inspection has been published in the website of the Corporation. 5.15.4 The list of eligible offerers / rejected offerers as per the findings of the decisions of the EOI Evaluation Committee / Inspection team will be published in the notice board and website of the EOI Inviting Authority, inviting complaints / suggestions from the bidders / public. 5.15.5 The complaints / suggestions received will be scrutinized by the EOI evaluation committee and their findings along with the final list of qualified eligible Offerers along with the list of drugs/items approved for each lab will be published in the notice board and website. 5.15.6 An offerer, at any stage of tender process or thereafter, in the event of being found after verification by the EOI Inviting Authority, to indulge in concealment or misrepresentation of facts, in respect of the claims of the offer, shall be debarred/black listed for a period as decided by the EOI Inviting Authority. 5.15.7 The EOI Inviting Authority’s decisions on the offer submitted shall be based on the decisions taken by the evaluation and inspection committees and otherwise as per the clauses as mentioned above.
