5.22 Notification of Award/Letter of Intent
5.22.1 The Corporation will notify the successful offerer (s) in writing, by
registered / speed post or by fax or by email (to be confirmed by
registered / speed post immediately afterwards) that its offer for testing of
drug(s), which have been selected by the EOI Inviting Authority, has
been accepted. This notification is undertaken by issuing a Letter of
Intent by the EOI Inviting Authority.
5.22.2 The successful offerer, upon receipt of the Letter of Intent, shall furnish
the required performance security and submit an agreement in the
prescribed format as given in Annexure-X within 15 days, failing which
the EMD will forfeited and the award will be cancelled.
5.22.3 The Letter of Intent shall constitute the conclusion of the EOI.
5.23 Signing of Contract
5. 23.1 The successful offerer shall execute an agreement on a non-judicial
Kerala Stamp paper of value of Rs.`100/- (stamp duty to be paid by the
tenderer) within 15 days from the date of the intimation from
Corporation informing that his offer has been accepted. The Specimen
format of agreement is available in Annexure-X.
5. 23.2 If the successful offerer fails to execute the agreement and / or to deposit
the required security deposit within the time specified or withdraws his
tender after the intimation of the acceptance of his tender has been sent
to him or owing to any other reasons, he is unable to undertake the
contract, his contract will be cancelled and the Earnest Money Deposit
deposited by him along with his tender shall stand forfeited by the
Corporation and laboratory shall also be blacklisted as per the procedure
detailed in clause 5.34, for a period up to three years immediately
succeeding the EOI year and the offerer will be ineligible to participate in
any of the offers/tenders of the Corporation for a period of three years.
5. 23.3 Non performance of any of the EOI provisions will disqualify a firm to
participate in the tender for a maximum period of three years.
5. 23.4 The offerer shall not, at any time, assign, sub-let or make over the
contract or the benefit thereof or any part thereof to any person or
persons what so ever.
5. 23.5 Corporation will be at liberty to terminate without assigning any reasons
thereof the contract either wholly or in part on 30 days notice. The
