2. In addition to the Commissions established by this Agreement, all exist<strong>in</strong>g public<br />

corporations <strong>and</strong> autonomous Agencies/Commissions shall operate under the present<br />

transitional arrangement, exclud<strong>in</strong>g the exist<strong>in</strong>g Commissions that have already been<br />

referred to under Articles XII <strong>and</strong> XIII <strong>of</strong> this Agreement.<br />

3. <strong>The</strong> m<strong>in</strong>isters, deputy <strong>and</strong> assistant m<strong>in</strong>isters, heads <strong>of</strong> autonomous agencies,<br />

commissions, public corporations <strong>and</strong> state-owned enterprises, who should preferably be<br />

technocrats, shall be representatives <strong>of</strong> a broad cross-section <strong>of</strong> the Liberian society.<br />

4. Allocation <strong>of</strong> m<strong>in</strong>isterial positions, deputy <strong>and</strong> assistant m<strong>in</strong>isterial positions, headship <strong>of</strong><br />

autonomous agencies, commissions, public corporations <strong>and</strong> state-owned enterprises shall<br />

be made to the Parties to this Agreement through a process <strong>of</strong> negotiation. <strong>The</strong> allocations<br />

as agreed to by the Parties are conta<strong>in</strong>ed <strong>in</strong> Annex 4 attached to the Agreement. Annex 4 is<br />

an <strong>in</strong>tegral part <strong>of</strong> this Agreement.<br />

5a. <strong>The</strong> Parties shall forward to the Transitional Chairman with<strong>in</strong> a period <strong>of</strong> seven (7) days,<br />

the name <strong>of</strong> one nom<strong>in</strong>ee for each position allocated to them.<br />

b. <strong>The</strong> Transitional Chairman shall with<strong>in</strong> a three (3) day period, forward from the<br />

<strong>in</strong>dividual list <strong>of</strong> nom<strong>in</strong>ees from the Parties, the c<strong>and</strong>idate for each position, to the NTLA.<br />

<strong>The</strong> NTLA shall, with<strong>in</strong> seven (7) days, confirm or reject the c<strong>and</strong>idate from each <strong>of</strong> the<br />

Parties’ list for each position.<br />

c. Where the NTLA is unable to confirm a c<strong>and</strong>idate from any <strong>of</strong> the Parties’ list so<br />

submitted, the Chairman shall, follow<strong>in</strong>g the same procedure as <strong>in</strong> ‘b’ above <strong>and</strong> with<strong>in</strong><br />

three (3) days <strong>of</strong> receiv<strong>in</strong>g notification <strong>of</strong> non-confirmation from the NTLA, submit other<br />

name(s) which shall be obta<strong>in</strong>ed for the relevant Parties to the NTLA. <strong>The</strong> NTLA shall<br />

thereafter, with<strong>in</strong> the same seven (7) day period, make a f<strong>in</strong>al selection thereon.<br />

6. <strong>The</strong> m<strong>and</strong>ate <strong>of</strong> the Cab<strong>in</strong>et shall <strong>in</strong>clude:<br />

a. Implementation <strong>of</strong> the decisions <strong>of</strong> the NTGL.<br />

b. Conduct <strong>of</strong> the usual activities <strong>of</strong> government m<strong>in</strong>istries.<br />

c. Initiation <strong>of</strong> policies <strong>and</strong> recommendation <strong>of</strong> same to the Transitional Chairman for<br />

approval.<br />

7. <strong>The</strong> Parties call on the United Nations, the ECOWAS, the AU, the International Monetary<br />

Fund, the World Bank, African Development Bank <strong>and</strong> other <strong>in</strong>ternational <strong>in</strong>stitutions <strong>in</strong> a<br />

position to do so, to assign tra<strong>in</strong>ed personnel <strong>and</strong> <strong>in</strong>ternational experts for the purpose <strong>of</strong><br />

provid<strong>in</strong>g technical support <strong>and</strong> assistance to the NTGL, especially for the function<strong>in</strong>g <strong>of</strong> its<br />

m<strong>in</strong>istries <strong>and</strong> parastatals.<br />

ARTICLE XXVII<br />

THE JUDICIARY<br />

1. <strong>The</strong> Judiciary shall be the third organ <strong>of</strong> the NTGL. Its structure shall rema<strong>in</strong><br />

unchanged.<br />

2. Immediately upon the <strong>in</strong>stallation <strong>of</strong> the NTGL, all members <strong>of</strong> the Supreme Court<br />

<strong>of</strong> Liberia i.e. the Chief Judge <strong>and</strong> all its Associate Justices shall be deemed to have<br />

resigned.<br />

3. Under the NTGL, all new judicial appo<strong>in</strong>tments shall be made by the Chairman <strong>of</strong><br />

the NTGL <strong>and</strong> approved by the NTLA. Nom<strong>in</strong>ations for such judicial appo<strong>in</strong>tments<br />

shall be based on a shortlist <strong>of</strong> c<strong>and</strong>idates for each position recommended by the<br />

National Bar Association, <strong>in</strong>clud<strong>in</strong>g the female lawyers.
