Tunstead and Happing Incorporated Hundreds Order<br />

6. This Order, dated 21 April 1869, provided for the repeal of two Acts 163 providing<br />

for the relief of the poor within the hundreds 164 of Tunstead and Happing in the<br />

county of Norfolk. The repeals were to take effect on 29 September 1869. Thereupon<br />

the churchwardens and overseers of the respective parishes were declared to have<br />

the same rights and duties as the churchwardens and overseers of any parish that<br />

was not governed by any local Act. The Order became spent once the repeals had<br />

taken effect or within a short period thereafter.<br />

Midhurst Union (Parish of Woolavington) Order<br />

7. This Order, dated 14 June 1869, provided for parts of the divided parish of<br />

Woolavington in Sussex to be annexed to the adjoining parishes of Fernhurst and<br />

Terwick, and for the remainder to be divided into two district parishes (to be called<br />

East Lavington and West Lavington). The Order was to take effect on 29 September<br />

1869.<br />

Effect of the repeal<br />

8. The purpose of the 1869 Act was to confirm the validity of the three Orders with<br />

effect from the passing of the Act on 26 July 1869. The 1869 Act thereupon became<br />

spent except to the extent that any of the Orders continued to serve any useful<br />

purpose. The Act is proposed for repeal on that basis, subject to an appropriate<br />

saving provision to preserve the validity of the individual Orders in so far as they<br />

have any continuing utility.<br />

Extent<br />

9. The 1869 Act had no effect outside the areas of the Orders (Norfolk and<br />

Sussex).<br />

Consultation<br />

10. HM Treasury, the Department for Communities and Local Government, the<br />

Department for Work and Pensions, Norfolk County Council, West Sussex County<br />

Council and the Local Government Association have been consulted about these<br />

repeal proposals.<br />
