her.” 631 A person is deemed to have caused or encouraged the seduction or prostitution of a<br />
girl by knowingly allowing the girl to “consort with” or be employed by an prostitute or<br />
“person of known immoral character.” Where a court is notified that a girl below the age of<br />
16 is in danger of seduction or prostitution without knowledge of her parents or guardians,<br />
the court may direct the parent or guardian to exercise due care <strong>and</strong> supervision. 632<br />
Indonesia’s Child Protection Act 2002 provides for children in need of “special protection”<br />
which includes those children who are “being economically or sexually exploited” <strong>and</strong> “who<br />
are the victims of kidnapping, sale <strong>and</strong> trading” 633 <strong>and</strong> provides for a punishment of up to five<br />
years <strong>and</strong> a fine up to one hundred million rupiah. 634 <strong>The</strong> law assigns the government or an<br />
authorized state institution with the responsibility <strong>and</strong> accountability of such children. 635<br />
Where children are victims of criminal acts, the law also specifies special protection in the<br />
form of institutional <strong>and</strong> non-institutional rehabilitation efforts, confidentiality, preventing<br />
stigmatization of the child, providing physical, mental <strong>and</strong> social safety guarantees <strong>and</strong><br />
ensuring access to information regarding the development of the <strong>legal</strong> process. 636 <strong>The</strong> law<br />
prohibits the “permitting, undertaking, ordering to be undertaken or participating in the<br />
exploitation of children” <strong>and</strong> for special protection including dissemination of laws<br />
concerning the protection of children from economic or sexual exploitation <strong>and</strong> for the<br />
involvement of “various government agencies, companies, labor unions, <strong>and</strong> nongovernmental<br />
<strong>and</strong> community organizations in the effort to eradicate the economic <strong>and</strong>/or<br />
sexual exploitation of children.” 637<br />
