I don't see an end to this.” (See photo 1.) Unfortunately, this is not an isolated situation. It may sound familiar to you. While the ultimate goal is to satisfy your customers, there are situations like this where you must be prepared to protect your company both financially and legally. That’s where PDCA standards come to the rescue. The most applicable standard to the above situation is PDCA-P4 entitled “Responsibility for Inspection and Acceptance of Surfaces Prior to Painting.” This standard is intended to be used on construction projects where the Painting and Decorating Contractor applies paints, coatings or wallcoverings over a surface assembled, constructed and/or prepared by another contractor or trade not under the Painting and Decorating Contractor’s control. The standard says that “Quality of Appearance” is a subjective term governed by the Contracting Entity and established by specification and reference standards. It is controlled by sample review and approval along with jobsite inspections and approvals. In other words, there should be a process in place to evaluate the quality of the work performed. The standard goes on to say that “the Painting and Decorating Contractor is not licensed, qualified, or obligated to render any final professional opinion regarding the “Quality of Appearance” of work performed by others.” Contractually, the painting contractor does not have the authority or responsibility to judge the work of the drywall finisher. | pdca.org So whose job is it to make that determination? According to the standard, the Contracting Entity has the responsibility to determine that a surface is complete and ready to receive painting or wallcoverings. The contracting entity is defined as the general contractor, owner of the property, construction manager, developer, or other entity legally responsible for the contractual agreement, or authorized agent of any of the above. So what is the painting contractor responsible for? The Painting and Decorating Contractor is required to inspect surfaces to be finished only to determine, by reasonable and visible evidence, that the finish will satisfactorily adhere to surfaces provided by others and will perform as specified. So before proceeding with painting, do you need written authorization that the surfaces have been inspected and accepted? Not necessarily. While it’s always better to get written approval, the standard says that “when the previous trade has completed its work and/or notification to proceed has been given (to the painting and decorating contractor), such action will be construed as tacit evidence that all work has been inspected, and that it is warrantable, completed and ready for finishing. If “Quality of Appearance” of a surface, prior to finishing, is judged marginal or unacceptable by others conducting essential inspection, such alleged defective work must be corrected prior to priming and finishing so that all surfaces are made complete and ready for finishing. If the unacceptable work is not made complete and ready for finishing, the Painting and Decorating Contractor will halt work until directed to proceed.” Assuming that our desperate painting contractor was told to proceed with his work, then the standard states that he’s entitled to additional compensation for the re-priming and refinishing that he described. “Once finishing has begun, as scheduled or as directed, the correction of “Defects and/or Latent Damage” is considered “Damage Repair” as per PDCA, Standard P1-04, Touch-Up Painting and Damage Repair- Financial Responsibility.” The quality of the Painting and Decorating Contractor’s painting work is judged by “a properly painted surface” as defined by PDCA standard P1 and the quality of wallcovering installation is assessed in accordance with PDCA-P6. Had a benchmark sample been applied and approved in accordance with PDCA standard P5, our unfortunate contractor’s problems may never have arisen. Use of the PDCA standards should avoid on-thejob conflicts as well as offer protection in disputes.
