An employee who is laid off, resigns or whose employment is terminated prior<br />
to <strong>the</strong> use of his paid leave bank, shall be paid <strong>the</strong> outstanding balance of his<br />
bank on his final pay cheque.<br />
Should operational needs as determined by management prohibit an employee<br />
from consuming his banked hours as paid leave, it shall be paid to him after<br />
December 31.<br />
19.10 All overtime provisions are subject to any applicable legislation including <strong>the</strong> Highway<br />
Traffic Act, Employment Standards, etc.<br />
Article 20 - Vacations<br />
20.01 Employees shall receive an annual vacation with pay in accordance with <strong>the</strong> credited<br />
service prior to <strong>the</strong> commencement of <strong>the</strong> vacation period as follows:<br />
Years of Service as of May 31 st<br />

Three (3) years or more 3 weeks 6%<br />

Sixteen (16) years or more 5 weeks 10%<br />
Twenty-four (24) years or more 6 weeks 12%<br />
20.02 Each week of vacation pay will be calculated at <strong>the</strong> appropriate percentage shown in<br />
20.01 of gross annual earnings in <strong>the</strong> vacation year ending May 31 st , or at his normal<br />
weekly hours times his current permanent classification rate, whichever is <strong>the</strong> greater.<br />
20.03 A permanent employee, who ceases to be entitled to receive pay from <strong>the</strong> Corporation<br />
due to being granted leave of absence without pay, except Pregnancy and Parental Leave<br />
or having exhausted his sick leave credits, shall only be entitled to vacation with pay in<br />
<strong>the</strong> proportion to <strong>the</strong> time he has been paid for during <strong>the</strong> year ending May 31 st which<br />
bears to <strong>the</strong> standard hours in <strong>the</strong> year.<br />
20.04 The Corporation shall set vacation times and in doing so shall take into account <strong>the</strong><br />
wishes of <strong>the</strong> employees in each department on <strong>the</strong> basis of seniority. Forms calling for<br />
vacation time shall be distributed by April 1 st and are to be completed and returned by<br />
April 15 th . Complete vacation schedules shall be posted by April 30 th .
