Recommendation: That the planning authority resolve to issue a planning permit under s.57 of the Land Use Planning and Approvals Act 1993 subject to the conditions below: 1. The use and development taking place in accordance with the approved development plans and those documents submitted in support of the application (reference number DA 171011), except as modified by the conditions of this consent 2. All development or uses arising from this permit shall be so maintained and utilised so as to minimise pollution of the immediate environment and generally harmonise with the existing environment all to the satisfaction of the responsible authority. 3. The building is to be finished in materials that do not unduly reflect sunlight onto neighbouring land or public roads and do not detract from the immediate streetscape and surroundings. 4. Prior to works commencing on site, the developer must either provide to Council written confirmation that the landowner has given consent to the passage over the land or that an exemption from doing so exists under either state or commonwealth legislation. 5. Any heritage artefacts disturbed during the development shall be reported in compliance with the regulatory requirements under the provision of the ‘Aboriginal Relics Act 1975’. - 44 - Ordinary Council Meeting – 18 January 2011

The King Island Planning Scheme 1995 is comprised of set of documents and maps that identify and distinguish development and use characteristics for a given area within the local government boundary. Council is in receipt of an application for consideration of an amendment to the King Island Planning Scheme 1995 land use zoning. The Proposed Amendment The proposed amendment is :- • That the King Island Planning Scheme 1995 plans be amended by altering the current zoning of the designated land from ‘Closed Residential to ‘Commercial’.
