16.2.1.5 The Municipal Manager may, <strong>on</strong> behalf of <str<strong>on</strong>g>the</str<strong>on</strong>g> Municipality, participate in any c<strong>on</strong>tract<br />
arranged by means of a <strong>co</strong>mpetitive bidding process by any o<str<strong>on</strong>g>the</str<strong>on</strong>g>r organ of state,<br />
subject <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> written approval of such organ of state as well as <str<strong>on</strong>g>the</str<strong>on</strong>g> written approval of<br />
<str<strong>on</strong>g>the</str<strong>on</strong>g> relevant c<strong>on</strong>trac<str<strong>on</strong>g>to</str<strong>on</strong>g>r.<br />
16.2.2 Specificati<strong>on</strong>s, Evaluati<strong>on</strong> Criteria and Procedures<br />
16.2.2.1 Bid documentati<strong>on</strong> must be <strong>co</strong>mpiled in ac<strong>co</strong>rdance with <str<strong>on</strong>g>the</str<strong>on</strong>g> general c<strong>on</strong>diti<strong>on</strong>s of<br />
c<strong>on</strong>tract and supply chain management guidelines of <str<strong>on</strong>g>the</str<strong>on</strong>g> nati<strong>on</strong>al treasury, and <str<strong>on</strong>g>the</str<strong>on</strong>g><br />
prescripts of <str<strong>on</strong>g>the</str<strong>on</strong>g> C<strong>on</strong>structi<strong>on</strong> Industry Development Board, in <str<strong>on</strong>g>the</str<strong>on</strong>g> case of a bid relating<br />
<str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>structi<strong>on</strong> industry.<br />
16.2.2.2 Bid documents shall clearly indicate <str<strong>on</strong>g>the</str<strong>on</strong>g> terms and c<strong>on</strong>diti<strong>on</strong>s of c<strong>on</strong>tract, specificati<strong>on</strong><br />
criteria for evaluati<strong>on</strong> and procedures <str<strong>on</strong>g>to</str<strong>on</strong>g> be followed where applicable, including <str<strong>on</strong>g>the</str<strong>on</strong>g><br />
criteria prescribed in terms of <str<strong>on</strong>g>the</str<strong>on</strong>g> Preferential Procurement Legislati<strong>on</strong>.<br />
16.2.2.3 The bid documentati<strong>on</strong> must <strong>co</strong>mpel all bidders <str<strong>on</strong>g>to</str<strong>on</strong>g> declare any c<strong>on</strong>flict of interest<br />
bidders may have in a specific bid, and must prescribe that bidders must furnish <str<strong>on</strong>g>the</str<strong>on</strong>g>ir<br />
tax reference registrati<strong>on</strong> numbers and identificati<strong>on</strong> numbers, where applicable.<br />
16.2.2.4 The bid documentati<strong>on</strong> must prescribe that disputes be settled by means of mutual<br />
c<strong>on</strong>sultati<strong>on</strong>, mediati<strong>on</strong> (with or without legal presentati<strong>on</strong>), or arbitrati<strong>on</strong> or when<br />
unsuccessful, in a South African <strong>co</strong>urt of law.<br />
16.2.2.5 The specificati<strong>on</strong>s and evaluati<strong>on</strong> criteria shall not be aimed at hampering <strong>co</strong>mpetiti<strong>on</strong>,<br />
but ra<str<strong>on</strong>g>the</str<strong>on</strong>g>r <str<strong>on</strong>g>to</str<strong>on</strong>g> ensure fair, equitable, transparent, <strong>co</strong>mpetitive and <strong>co</strong>st effective bidding,<br />
as well as <str<strong>on</strong>g>the</str<strong>on</strong>g> protecti<strong>on</strong> or advancement of pers<strong>on</strong>s, or categories of pers<strong>on</strong>s.<br />
16.2.2.6 The specificati<strong>on</strong>s shall not menti<strong>on</strong> trade names or particular processes of manufacture<br />
unless <str<strong>on</strong>g>the</str<strong>on</strong>g>se are <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>on</strong>ly acceptable products. However, where <str<strong>on</strong>g>the</str<strong>on</strong>g> use of trade names,<br />
trade marks or origin is <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>on</strong>ly known way of accurately describing <str<strong>on</strong>g>the</str<strong>on</strong>g> products<br />
required, <str<strong>on</strong>g>the</str<strong>on</strong>g> words “or o<str<strong>on</strong>g>the</str<strong>on</strong>g>r equal and approved ”shall be included in <str<strong>on</strong>g>the</str<strong>on</strong>g> specificati<strong>on</strong>s<br />
menti<strong>on</strong>ed in <str<strong>on</strong>g>the</str<strong>on</strong>g> bid document.<br />
16.2.2.7 Where <str<strong>on</strong>g>the</str<strong>on</strong>g> specificati<strong>on</strong>s are based <strong>on</strong> standard documents available <str<strong>on</strong>g>to</str<strong>on</strong>g> bidders, a<br />
reference <str<strong>on</strong>g>to</str<strong>on</strong>g> those documents is sufficient.<br />
16.2.2.8 The CFO in c<strong>on</strong>sultati<strong>on</strong> with <str<strong>on</strong>g>the</str<strong>on</strong>g> Head of Department c<strong>on</strong>cerned may, if necessary,<br />
<strong>co</strong>mmunicate with bidders and prospective bidders prior <str<strong>on</strong>g>to</str<strong>on</strong>g> bid closing in order <str<strong>on</strong>g>to</str<strong>on</strong>g> supply<br />
additi<strong>on</strong>al informati<strong>on</strong> or <str<strong>on</strong>g>to</str<strong>on</strong>g> clarify vague points in <str<strong>on</strong>g>the</str<strong>on</strong>g> bid documents. Such<br />
<strong>co</strong>mmunicati<strong>on</strong> shall be in <str<strong>on</strong>g>the</str<strong>on</strong>g> form of a prescribed notice and shall, where possible, be<br />
issued at least <strong>on</strong>e week prior <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> bid closing date.<br />
16.2.2.9 The bid documentati<strong>on</strong> must, if <str<strong>on</strong>g>the</str<strong>on</strong>g> value of <str<strong>on</strong>g>the</str<strong>on</strong>g> transacti<strong>on</strong> is expected <str<strong>on</strong>g>to</str<strong>on</strong>g> exceed<br />
R10 milli<strong>on</strong> (VAT included), require bidders <str<strong>on</strong>g>to</str<strong>on</strong>g> furnish :<br />
(a) If required by law an audited financial statements for <str<strong>on</strong>g>the</str<strong>on</strong>g> past 3 (three) years or<br />
since <str<strong>on</strong>g>the</str<strong>on</strong>g> establishment if established during <str<strong>on</strong>g>the</str<strong>on</strong>g> past 3 (three) years;<br />
(b) a certificate signed by <str<strong>on</strong>g>the</str<strong>on</strong>g> bidder certifying that <str<strong>on</strong>g>the</str<strong>on</strong>g> bidder has undisputed<br />
<strong>co</strong>mmitments for municipal services <str<strong>on</strong>g>to</str<strong>on</strong>g>wards a municipality or o<str<strong>on</strong>g>the</str<strong>on</strong>g>r service provider<br />
in respect of which payment is overdue for more than 30 (thirty) days;<br />
