CODE OF ORDINANCES<br />
Chapter 15 - SOLID WASTE DISPOSAL AND RECYCLING<br />
ARTICLE I. IN GENERAL<br />
Section 15-1. Depositing, etc., slops, filthy substances, refuse, etc., on<br />
sidewalk, street, etc.<br />
No person shall throw, deposit, cause, or permit to be thrown or deposited, or permit to pass through any sink spout,<br />
upon any sidewalk, street, alley, or public park or other public places within the <strong>City</strong> any slops, filthy water, urine,<br />
carrion, or filthy substance, or any metal cans, metal ware, ashes, refuse, garbage, or rubbish <strong>of</strong> any kind or<br />
description.<br />
Section 15-2. Definitions.<br />
ARTICLE II. SOLID WASTE<br />
For the purposes <strong>of</strong> this article, the following words and phrases shall have the meanings respectively ascribed to<br />
them by this Section:<br />
Ashes. The residue from the burning <strong>of</strong> wood, coal, coke, or other combustible materials.<br />
Garbage. Putrescible animal and vegetable wastes resulting from the handling, preparation, cooking, and<br />
consumption <strong>of</strong> food.<br />
Recyclables. Nonputrescible solid wastes (excluding ashes), consisting <strong>of</strong> both combustible and noncombustible<br />
wastes, such as paper, cardboard, metal cans, glass, plastics and similar materials which can be recycled into other<br />
useable products.<br />
Rubbish. Nonputrescible solid wastes (excluding ashes), consisting <strong>of</strong> both combustible and noncombustible<br />
wastes, such as paper, cardboard, metal cans, wood, glass, bedding, crockery, and similar materials.<br />
Yard Waste. Natural solid wastes resulting from the maintenance <strong>of</strong> lawns and trees, including but not limited to<br />
leaves, tree limbs, brush, pine needles, pine cones, and grass clippings.<br />
Section 15-3. Contract for collection generally.<br />
The <strong>City</strong> Council may contract with any person for the collection <strong>of</strong> refuse, garbage, rubbish, yard waste, and<br />
recyclables in the <strong>City</strong>. Such contract shall be for a term specified by the <strong>City</strong> Council and the Council shall<br />
advertise for the letting <strong>of</strong> bids for the purpose <strong>of</strong> collecting-refuse, garbage, rubbish, yard waste, and recyclables at<br />
least thirty(30) days prior to the entering into <strong>of</strong> any contract for this purpose.<br />
Section 15-4. Same - Bond required.<br />
The person entering into any contract as provided for in Section 15-3 shall, before such contract shall become<br />
binding upon the <strong>City</strong>, file with the <strong>City</strong> Clerk a bond in the amount <strong>of</strong> at least one-thousand dollars ($1,000.00)<br />
with sufficient surety in the discretion <strong>of</strong> the <strong>City</strong> Council, conditioned for the faithful performance <strong>of</strong> such contract.<br />
Should default occur on such bond, the <strong>City</strong> shall have an action against the principal and the surety on such bond,<br />
or any <strong>of</strong> them, for recovery <strong>of</strong> any cost or expense suffered by the <strong>City</strong> as a result <strong>of</strong> such default, together with all<br />
costs <strong>of</strong> such action.<br />
