CITY OF NEW BUFFALO<br />
CODE OF ORDINANCES<br />
With respect to subsection (1)(c), a person is guilty <strong>of</strong> a separate <strong>of</strong>fense for each day that the person fails to<br />
comply with a stop construction order validly issued by an enforcing agency and for each week that the person<br />
fails to comply with any other order validly issued by an enforcing agency. With respect to subsection (1)(a) or<br />
(d), a person is guilty <strong>of</strong> a separate <strong>of</strong>fense for each knowing violation <strong>of</strong> this act or a rule promulgated under<br />
this act and for each false or misleading written statement or omission <strong>of</strong> required information or statement<br />
knowingly made in an application, petition, request for approval or appeal to an enforcing agency, a<br />
construction board <strong>of</strong> appeals, a board or the commission. With respect to subsection (1)(b), a person is guilty<br />
<strong>of</strong> a separate <strong>of</strong>fense for each knowing violation <strong>of</strong> a condition <strong>of</strong> a building permit.<br />
B. If a governmental subdivision has the responsibility <strong>of</strong> administering and enforcing this act and prosecutes a<br />
violation <strong>of</strong> this act, the governmental subdivision may retain a fine imposed upon conviction. If a<br />
governmental subdivision has the responsibility <strong>of</strong> administering and enforcing this act, the governmental<br />
subdivision may by ordinance designate a violation described in subsection (1) or (2) as a municipal civil<br />
infraction and provide a civil fine for the violation. The governmental subdivision may retain the civil fine<br />
imposed upon judgment.<br />

Section 5-2. Electrical code agency designated.<br />
Pursuant to the provisions <strong>of</strong> Act 230 <strong>of</strong> the Public Acts <strong>of</strong> 1972, as amended, and <strong>of</strong> the Michigan Electrical Code<br />
which consists <strong>of</strong> the National Electrical Code, with amendments and deletions, the Electrical Inspector appointed<br />
by the <strong>City</strong> is hereby designated as the enforcing agency to discharge the responsibilities <strong>of</strong> the <strong>City</strong> under Act 230<br />
<strong>of</strong> the Public Acts <strong>of</strong> 1972, State <strong>of</strong> Michigan, as amended. The <strong>City</strong> hereby assumes responsibility for the<br />
administration and enforcement <strong>of</strong> said Michigan Electrical Code throughout its corporate limits.<br />
Section 5-3. Mechanical code agency designated.<br />
Pursuant to the provisions <strong>of</strong> the Building Officials and Code Administrators International, Inc., Basic Building<br />
Code (BOCA), including all amendments and supplements thereto, the Mechanical Inspector appointed by the <strong>City</strong><br />
is hereby designated as the enforcing agency to discharge the responsibilities <strong>of</strong> the <strong>City</strong> under the aforesaid Act and<br />
Code. The <strong>City</strong> hereby assumes responsibility for the administration and enforcement <strong>of</strong> said Act throughout its<br />
corporate limits.<br />
Section 5-4. Plumbing code agency designated. [Ord. 174, 2/19/2008]<br />
Pursuant to the provisions <strong>of</strong> the Michigan Plumbing Code, in accordance with Section 8b (6) <strong>of</strong> Act 230 <strong>of</strong> the<br />
Public Acts <strong>of</strong> 1972, as amended, the plumbing inspector <strong>of</strong> the <strong>City</strong> <strong>of</strong> <strong>New</strong> <strong>Buffalo</strong> is hereby designated as the<br />
enforcing agency to discharge the responsibilities <strong>of</strong> the <strong>City</strong> <strong>of</strong> <strong>New</strong> <strong>Buffalo</strong> under Act 230 <strong>of</strong> the Public Acts <strong>of</strong><br />
1972, as amended, pertaining to the plumbing installations. The <strong>City</strong> <strong>of</strong> <strong>New</strong> <strong>Buffalo</strong> hereby assumes responsibility<br />
for the administration and enforcement <strong>of</strong> said Act throughout its corporate limits.<br />
