CODE OF ORDINANCES<br />
Chapter 17 - SPECIAL ASSESSMENT IMPROVEMENTS<br />
Section 17-1. Definitions.<br />
ARTICLE I. IN GENERAL.<br />
For the purposes <strong>of</strong> this Chapter, the following words and phrases shall have the meanings respectively ascribed to<br />
them by this Section.<br />
Cost. The word "cost" shall include the expense <strong>of</strong> survey, spreading <strong>of</strong> roll, notice, advertising, printing, financing,<br />
legal, engineering, construction, condemnation, and all other costs incidental to the making <strong>of</strong> the improvement.<br />
Engineer. The engineer specifically employed for work on the improvement.<br />
Improvement. Any public betterment.<br />
Lot or parcel <strong>of</strong> land. Any subdivision lot or portion there<strong>of</strong> as <strong>of</strong>ficially platted or any unplatted parcel <strong>of</strong> land as<br />
may be described on any <strong>of</strong>ficial record.<br />
Manager, Assessor, Clerk, Treasurer. Whenever reference is made to the <strong>City</strong> Manager, Assessor, Clerk, or<br />
Treasurer, it shall mean those persons duly appointed to such <strong>of</strong>fices or positions in the <strong>City</strong>.<br />
Owner. The last recorded title holder <strong>of</strong> any lot or parcel <strong>of</strong> land, or the person whose name is last listed upon the<br />
<strong>City</strong> tax roll as the owner <strong>of</strong> a certain lot or parcel <strong>of</strong> land.<br />
Section 17-2. <strong>General</strong>ly; effect.<br />
ARTICLE II. ADVISORY PETITIONS.<br />
The <strong>City</strong> Council, in order to ascertain whether or not a reasonable number <strong>of</strong> property owners to be assessed desire<br />
any particular improvement to be made, may request and receive a petition therefor, or may receive such a petition<br />
voluntarily presented, but in either event, such petition shall be advisory only and shall not be jurisdictional.<br />
Section 17-3. Contents.<br />
All advisory petitions shall be addressed to the <strong>City</strong> Council and contain a brief description <strong>of</strong> the improvement<br />
sought to be made and shall be signed by property owners only, whose signatures shall be followed by a brief<br />
description <strong>of</strong> the property owned by them. The signatures on such petitions shall be verified by the oath <strong>of</strong> one (1)<br />
or more <strong>of</strong> the circulators <strong>of</strong> such petition, before filing.<br />
Section 17-4. Filing; verification; referral to <strong>City</strong> Manager; Council presentation.<br />
Advisory petitions shall be filed with the <strong>City</strong> Clerk who shall check them for signatures and correctness and if they<br />
are found to be in order, he/she shall refer them to the <strong>City</strong> Manager who shall present them to the <strong>City</strong> Council at<br />
its next regular or special meeting called for that purpose, together with his/her recommendations.<br />
