CODE OF ORDINANCES<br />

Section 10-7. Creation.<br />

ARTICLE III. PARKING VIOLATIONS BUREAU<br />

It is hereby created for the <strong>City</strong> a Parking Violations Bureau, pursuant to Act No. 154 <strong>of</strong> the Public Acts <strong>of</strong> 1968, as<br />

amended.<br />

Section 10-8. Powers, duties, and membership.<br />

The Parking Violations Bureau shall be in the charge <strong>of</strong> the Chief <strong>of</strong> Police. The Bureau shall enforce, as<br />

hereinafter provided, all non-moving traffic and/or parking violations as civil infractions within the <strong>City</strong> and other<br />

regulations allowed by law. Each Patrol Officer and Reserve Officer <strong>of</strong> the Police Department shall be members <strong>of</strong><br />

the Parking Violations Bureau to act in the absence <strong>of</strong> the Chief <strong>of</strong> Police, and so shall any other employees <strong>of</strong> the<br />

<strong>City</strong> as designated in writing by the <strong>City</strong> Manager. Such members shall be known as Parking Enforcement Officials<br />

<strong>of</strong> the Parking Violations Bureau. The <strong>City</strong> Clerk and <strong>City</strong> Treasurer, along with their duly appointed designees,<br />

shall be members <strong>of</strong> the Parking Violations Bureau to act as the Treasurer and/or Clerk <strong>of</strong> said Bureau in the<br />

absence <strong>of</strong> the Chief <strong>of</strong> Police or any other Parking Enforcement Official for the collection <strong>of</strong> fines and penalties.<br />

Section 10-9. Resolution <strong>of</strong> violations.<br />

Said Bureau is hereby authorized to grant any person charged with a civil infraction <strong>of</strong> any non-moving traffic<br />

and/or parking violation the option <strong>of</strong> either paying said Bureau the fines and penalties hereinafter provided for such<br />

violations, or <strong>of</strong> answering to a complaint before the magistrate or any court having competent jurisdiction. It shall<br />

not be mandatory for the Bureau to grant any person receiving a citation the optional choice provided above.<br />

Section 10-10. Delinquent violations.<br />

If any person shall receive a citation for a non-moving traffic and/or parking violation and neglects and/or refuses to<br />

pay the fine or penalty herein provided at the said Bureau, then it shall be the duty <strong>of</strong> the person in charge <strong>of</strong> such<br />

Bureau, or some other <strong>of</strong>ficer having knowledge <strong>of</strong> the facts to forthwith make complaint before any court having<br />

competent jurisdiction, and to bring the violator before the court to answer the said complaint.<br />

Section 10-11. Fines and penalties.<br />

The schedule <strong>of</strong> fines for a non-moving traffic and/or parking violation within the <strong>City</strong> shall be as determined from<br />

time to time by resolution <strong>of</strong> the <strong>City</strong> Council. The Council may also set from time to time the length <strong>of</strong> time a<br />

violation shall be considered a civil infraction, and at which point any unresolved violation may become a criminal<br />

misdemeanor subject to the provisions <strong>of</strong> Section 1-7 <strong>of</strong> this Code.<br />

Section 10-12. Receipt and accounting <strong>of</strong> fines and penalties.<br />

It shall be the duty <strong>of</strong> the Parking Violations Bureau to keep a full and complete and accurate account <strong>of</strong> all<br />

violations settled before it, and <strong>of</strong> all monies received by it and it shall deposit all such monies with the <strong>City</strong><br />

Treasurer within a timely fashion, with an exact copy or carbon copy <strong>of</strong> the receipt given to the violator for any sum<br />

paid, and in all cases it shall be the duty <strong>of</strong> the <strong>of</strong>ficer receiving any sums to give the violator a receipt.<br />
