CODE OF ORDINANCES<br />

Chapter 19 - WATER<br />

ARTICLE I. IN GENERAL.<br />

Section 19-1. Contamination and pollution generally.<br />

It shall be unlawful for any person to do any act, or to allow to be done any act, that may contaminate or pollute or<br />

contribute to the contamination or pollution <strong>of</strong> the water supply wells or intake, or the water system in general <strong>of</strong> the<br />

<strong>City</strong>. A violation <strong>of</strong> this Section shall be considered a misdemeanor and subject to the penalties prescribed in<br />

Section 1-7 <strong>of</strong> this Code.<br />

Section 19-2. Constructing or maintaining possible source <strong>of</strong> contamination,<br />

etc. within two-hundred (200) feet <strong>of</strong> municipal wells.<br />

It shall be unlawful for any person to construct or maintain, or permit to be constructed or maintained, within a<br />

radius <strong>of</strong> two-hundred (200) feet from any <strong>of</strong> the municipal water wells or intakes within the <strong>City</strong> from which the<br />

<strong>City</strong> draws its water supplies, any source <strong>of</strong> possible contamination or pollution to such wells and intakes. A<br />

violation <strong>of</strong> this Section shall be considered a misdemeanor and subject to the penalties prescribed in Section 1-7 <strong>of</strong><br />

this Code.<br />

ARTICLE II. MUNICIPAL WATER SERVICE.<br />

Section 19-3. Applications for service.<br />

Applications for water service shall be filed with the <strong>City</strong> Clerk upon a form to be supplied by the Clerk. Such<br />

application shall state the name <strong>of</strong> the applicant and the premises to be served.<br />

Section 19-4. Municipal water service fee billing. [Ord. 176, 4/15/2008]<br />

Each property owner shall be responsible for municipal water service fees for each <strong>of</strong> their properties. The <strong>City</strong><br />

shall not transfer responsibility for any municipal water service fees to a tenant.<br />

Section 19-5. Disposition <strong>of</strong> revenues derived; "water system fund account."<br />

All revenues and monies derived from the operation <strong>of</strong> the water system shall be paid to and held by the <strong>City</strong><br />

Treasurer separate and apart from all other funds <strong>of</strong> the <strong>City</strong> and all <strong>of</strong> such sums and all other funds and monies<br />

incident to the operation <strong>of</strong> such system, as may be delivered to the Treasurer, shall be deposited in a separate fund<br />

designated the "water system fund account," and the Treasurer shall administer such fund in every respect in a<br />

manner provided by the laws <strong>of</strong> the state and all other laws pertaining thereto.<br />

Section 19-6. Records and accounts; annual audit.<br />

The <strong>City</strong> Treasurer shall establish a proper system <strong>of</strong> accounts and shall keep proper records, books, and accounts in<br />

which complete and correct entries shall be made <strong>of</strong> all transactions relative to the <strong>City</strong> water system and at regular<br />

annual intervals the <strong>City</strong> Council shall cause to be made an audit by an independent auditing concern <strong>of</strong> the books to<br />

show the receipts and disbursements <strong>of</strong> the <strong>City</strong> water system.<br />
