CODE OF ORDINANCES<br />

ARTICLE III. FIRE SERVICE CHARGES<br />

Section 6-26. Fire Service Charges. [Ord. 157, 4/19/2006]<br />

The following charges will be based on a time per-hour: firefighter, equipment ($250.00/hr/truck) and the fair value<br />

<strong>of</strong> material used, and shall hereafter be due payable to the <strong>New</strong> <strong>Buffalo</strong> <strong>City</strong> Fire Department from a recipient <strong>of</strong> any<br />

services from the <strong>New</strong> <strong>Buffalo</strong> <strong>City</strong> Fire Department.<br />

Charges set out in this section and any exemptions may be determined and adjusted from time to time by resolution<br />

<strong>of</strong> the <strong>New</strong> <strong>Buffalo</strong> <strong>City</strong> Council and such adjustments shall not require a formal amendment to this ordinance.<br />

Section 6-27. Time for payment. [Ord. 157, 4/19/2006]<br />

All the foregoing charges shall be due and payable to the <strong>New</strong> <strong>Buffalo</strong> <strong>City</strong> Fire Department within 30 days after the<br />

date service is rendered.<br />

Section 6-28. Exemptions. [Ord. 157, 4/19/2006]<br />

The following properties and services shall be exempt from the foregoing charges:<br />

A. Fire involving <strong>City</strong> buildings, grounds and/or property.<br />

B. Fire service provided outside the jurisdiction <strong>of</strong> the <strong>City</strong> under a mutual aid contract with an adjoining<br />

municipality.<br />

C. Fire service provided to property belonging to a <strong>New</strong> <strong>Buffalo</strong> <strong>City</strong> taxpayer (which covers their fire and rescue<br />

services.)<br />

Section 6-29. Collection <strong>of</strong> Charges. [Ord. 157, 4/19/2006]<br />

The <strong>New</strong> <strong>Buffalo</strong> <strong>City</strong> Fire Department is hereby delegated the authority and responsibility for billing and collecting<br />

charges and may proceed in District Court to collect any monies remaining unpaid and shall pursue any and all other<br />

remedies provided by law for the collection <strong>of</strong> said charges.<br />

All funds collected shall be deposited in the general fund <strong>of</strong> the <strong>City</strong>.<br />

Section 6-30. Non-exclusive Charge. [Ord. 157, 4/19/2006]<br />

The foregoing rates and charges shall not be exclusive <strong>of</strong> the charges that may be made by the <strong>New</strong> <strong>Buffalo</strong> <strong>City</strong><br />

Fire Department for the cost and expense <strong>of</strong> maintaining a fire department but shall be supplemental thereto.<br />

Charges may additionally be collected by <strong>New</strong> <strong>Buffalo</strong> <strong>City</strong> through general taxation procedures provided by law or<br />

by a special assessment established as provided by law.<br />

<strong>General</strong> fund appropriations may be made to cover such additional cost and expenses.<br />

[Ord. 157, Section 3: Should any provision or part <strong>of</strong> the within ordinance be declared by any court <strong>of</strong> competent<br />

jurisdiction to be invalid or unenforceable, the same shall not affect the validity or enforceability <strong>of</strong> the balance <strong>of</strong><br />

this ordinance which shall remain in full force and effect.]<br />
