CITY OF NEW BUFFALO<br />

CODE OF ORDINANCES<br />

ARTICLE XII. WATER DEPARTMENT<br />

Section 2-91. Water Department – Creation and Supervision. [Ord. 195, 5/31/2012]<br />

A. Pursuant to the <strong>City</strong> Charter, there is hereby created a Water Department.<br />

B. As directed by the <strong>City</strong> Manager, the head <strong>of</strong> such department shall be the Water Department Superintendent.<br />

C. The Water Department Superintendent shall have the power to hire and discharge the employees <strong>of</strong> his or her<br />

department upon the advice and consent <strong>of</strong> the <strong>City</strong> Manager, subject to the provisions <strong>of</strong> any merit or civil<br />

service system, or any collective bargaining agreement.<br />

D. The Water Department Superintendent shall not be construed to be an administrative <strong>of</strong>ficer as defined in the<br />

<strong>City</strong> Charter.<br />

Section 2-92. Same – function; duties, authorities, and responsibilities <strong>of</strong> the<br />

<strong>of</strong>ficers. [Ord. 195, 5/31/2012]<br />

A. The function <strong>of</strong> the Water Department is to serve as a public utility by efficiently operating a water filtration<br />

plant, water distribution system, and water billing system to provide municipal water in said department’s<br />

service area, with such water meeting or exceeding State <strong>of</strong> Michigan standards for quality, and to provide a<br />

sufficient quantity <strong>of</strong> water to meet the <strong>City</strong>’s goals for (1) fire protection purposes and (2) projected future<br />

needs.<br />

B. The duties, authorities and responsibilities <strong>of</strong> the <strong>of</strong>ficers <strong>of</strong> the Water Department are commiserate with the<br />

function <strong>of</strong> said department.<br />

C. The <strong>City</strong> Manager may prescribe such duties and responsibilities <strong>of</strong> the <strong>of</strong>ficers <strong>of</strong> the Water Department which<br />

are not inconsistent with the <strong>City</strong> Charter, these ordinances, or resolution adopted concerning such duties and<br />

authorities under the authority <strong>of</strong> the <strong>City</strong> Charter.<br />
