When written notice relates to an action that requires parental consent, MSD may give written notice at <strong>the</strong> same<br />

time as <strong>the</strong> parental consent is being obtained.<br />

CONTENT OF WRITTEN NOTICE<br />

Written notice must:<br />

� Describe <strong>the</strong> action(s) that MSD proposed or refused to take;<br />

� Explain why MSD is proposing or refusing to take <strong>the</strong> action(s);<br />

� Describe <strong>the</strong> evaluation procedure, assessment, or report MSD used in deciding to propose or refuse <strong>the</strong><br />

action(s);<br />

� Include a statement that parents have protections under <strong>the</strong> procedural safeguards provisions in IDEA;<br />

� Tell parents how <strong>the</strong>y can obtain a description of <strong>the</strong> procedural safeguards if <strong>the</strong> action that MSD is<br />

proposing or refusing is not an initial referral <strong>for</strong> evaluation;<br />

� Include resources <strong>for</strong> parents to contact <strong>for</strong> help in understanding <strong>the</strong> IDEA;<br />

� Describe any o<strong>the</strong>r choices that <strong>the</strong> child's Individualized Family Service Plan (IFSP) team or Individualized<br />

Education Program (IEP) team considered and <strong>the</strong> reasons why those choices were rejected.<br />

CONSENT<br />

I. Parent Consent <strong>for</strong> IFSP Services Only<br />

Written in<strong>for</strong>med consent shall be obtained be<strong>for</strong>e:<br />

� Initial evaluation and assessment of <strong>the</strong> child;<br />

� Determining <strong>the</strong> resources, priorities, and concerns of <strong>the</strong> family related to enhancing <strong>the</strong> development of <strong>the</strong><br />

child;<br />

� Initiating <strong>the</strong> provision of early intervention services and additional assessments;<br />

� If written consent is not given, <strong>the</strong> local lead agency shall make reasonable ef<strong>for</strong>ts to ensure that <strong>the</strong> parent:<br />

o Is fully aware of <strong>the</strong> nature of <strong>the</strong> evaluation and assessment or <strong>the</strong> services that will be available;<br />

o Understands that <strong>the</strong> child will not be able to receive <strong>the</strong> evaluation and assessment or <strong>the</strong> services,<br />

unless written consent is given.<br />

II. Parent Right to Decline Service <strong>for</strong> IFSP Services Only<br />

A parent of an eligible child may determine whe<strong>the</strong>r <strong>the</strong>y, <strong>the</strong>ir child, or o<strong>the</strong>r family members will accept or decline<br />

any early intervention service and may decline this service after first accepting it without jeopardizing o<strong>the</strong>r early<br />

intervention services. If a parent chooses to continue early intervention services <strong>for</strong> a child 3 or older, an<br />

educational component must be included. If <strong>the</strong> parent does not want <strong>the</strong> educational component, <strong>the</strong>y are not<br />

eligible to receive early intervention services.<br />

III. All O<strong>the</strong>r Parent Consent<br />

MSD must get parental consent to assess a child <strong>for</strong> special education and related services, be<strong>for</strong>e providing<br />

special education and related services. Parents have <strong>the</strong> right to withdraw consent at anytime. There are some<br />

exceptions to consent <strong>for</strong> evaluation.<br />

Consent means that <strong>the</strong> parents:<br />

� Have been in<strong>for</strong>med of all in<strong>for</strong>mation relevant to <strong>the</strong> activity <strong>for</strong> which consent is sought, in <strong>the</strong>ir native<br />

language or o<strong>the</strong>r mode of communication;<br />

� Understand and agree in writing to <strong>the</strong> carrying out of <strong>the</strong> activity <strong>for</strong> which <strong>the</strong>ir consent is sought and <strong>the</strong><br />

consent describes that activity and lists <strong>the</strong> records (if any) that will be released and to whom;<br />

� Understand that <strong>the</strong> granting of consent is voluntary and may be revoked at any time.<br />
