later than July 15. The deadline for resignation of a teacher affected by this exception shall be<br />

extended to July 31.<br />

On a case-by-case basis, in lieu of suspending a contract in whole, the <strong>Board</strong> may suspend a<br />

contract in part, so that an individual is required to work a percentage of the time the employee<br />

otherwise is required to work under the contract and receives a commensurate percentage of the<br />

full compensation the employee would receive under the contract.<br />

D. Notification<br />

Prior to a reduction in staff, the <strong>Board</strong> shall give written notice to the Association, through its<br />

President, of its intent to effect a reduction in staff. Such notice shall contain the reason for the<br />

reduction in staff and the positions affected in the District.<br />

E. Order of Reduction<br />

1. For the purposes of this section, teachers with “comparable” evaluations are those<br />

teachers whose overall or composite rating is at the same level. For the 2012-2013<br />

school year, teachers will be treated as comparable for the purpose of RIF.<br />

For the 2013-2014 school year, the determination of the overall or composite rating will<br />

be dependent upon the new evaluation framework, procedures and processes referenced<br />

in Article 401, Section H.<br />

2. In making reductions, the <strong>Board</strong> will proceed to suspend contracts in accordance with the<br />

recommendation of the Superintendent who, within each teaching field affected, will give<br />

preference to teachers on continuing contract. The <strong>Board</strong> will not give preference to any<br />

teacher based on seniority except when making a decision between teachers who have<br />

comparable evaluations as defined in E.1 above.<br />

F. Procedure<br />

1. On or before November 1 of each school year, the Association President and the<br />

Superintendent will cooperatively develop a seniority list. Teachers shall be placed on all<br />

lists for which they are certified/licensed. Any Bargaining Unit Member who wishes to<br />

challenge the accuracy of the seniority list must submit the basis for the challenge in<br />

writing on or before December 1 with a copy to the Association President and the<br />

Superintendent. A final seniority list reflecting any corrections will be published on or<br />

before December 31.<br />

2. Exceptions to preferences for retention based on seniority where teachers otherwise have<br />

comparable evaluations may be made when it is necessary to do so in order to comply<br />

with <strong>State</strong> and Federal laws relating to employment.<br />

3. “Seniority” will be defined as the length of continuous service as a certificated/licensed<br />

employee under regular full-time contract in this District.<br />

a. <strong>Board</strong> approved unpaid leaves of absence will not interrupt seniority, but time<br />

spent on such leave shall not count toward seniority.<br />

b. If two (2) or more teachers have the same length of continuous service, seniority<br />

will be determined by:<br />

1) the date of the <strong>Board</strong> meeting at which the teacher was hired; and then<br />
