3. If the parties have complied with the dispute settlement procedures outlined above and<br />
there has been no settlement by the expiration date of the Collective Bargaining<br />
Agreement, the Association retains the right to strike as outlined in ORC 4117.14(D)(2).<br />
ARTICLE 3.<br />
GRIEVANCE PROCEDURE<br />
301 DEFINITION OF A GRIEVANCE (P.N. 1988)<br />
A “grievance” is a claim of a teacher, a group of teachers, or the Association that this Contract has<br />
been misinterpreted, violated, or misapplied.<br />
302 DEFINITION OF TERMS (P.N. 1986)<br />
A. The term "grievant" or "aggrieved" shall include all teachers, any group of teachers acting as a<br />
class, or the Association acting on behalf of itself or for any teacher or group of teachers.<br />
B. "Representation" or "Representatives," as provided for in this Section, shall be any member of<br />
the Association chosen by the aggrieved, legal counsel of the aggrieved, or any other person of<br />
the aggrieved's choosing.<br />
303 RIGHTS OF <strong>THE</strong> GRIEVANT AND <strong>THE</strong> ASSOCIATION (P.N. 2006)<br />
A. A grievant may appeal on his/her own behalf or may be represented at any and all steps of the<br />
grievance procedure by the Association, or by counsel, or by any other person of the<br />
aggrieved's choice, except that the aggrieved may not be represented by an officer or employee<br />
of any teachers' organization other than the Association.<br />
B. A grievant shall have the right to present a claim in accordance with the procedure described<br />
herein, free from interference, coercion, restraint, discrimination, or reprisal. The Association<br />
shall have the right to be present at the settlement and offer testimony to insure that the<br />
settlement is not inconsistent with the terms of this Negotiated Agreement.<br />
C. Nothing contained herein shall limit or otherwise exclude any grievant from seeking redress<br />
from any governmental agency, regulatory body, or any court of law with jurisdiction to this<br />
School District; however, if the grievant elects to utilize the grievance procedure, the grievant<br />
may not pursue redress in any other forum.<br />
D. No member of the Association may submit a grievance to arbitration without the consent of the<br />
Association.<br />
E. If a grievance appears to arise from the action of an authority higher than the Immediate<br />
Supervisor and/or affects a group of members or the Association, it may be submitted at Step<br />
Two, below.<br />
F. Any grievance not settled at an informal level shall be reduced to writing and state such relief<br />
sought.<br />
G. Any grievance may be dealt with by the grievant seeking redress with the Immediate<br />
Supervisor; however, this informal procedure does not preclude the filing of any grievance at<br />
any appropriate formal level.<br />
H. The fact that a grievant files a grievance shall not be recorded in the grievant's personnel file or<br />
any file used in the transfer, assignment, or promotion process; nor shall such fact be used in<br />
