ARTICLE 2.<br />

NEGOTIATIONS PROCEDURE<br />

201 MEETINGS (P.N. 2006)<br />

A. A written request for meetings will be submitted by the Association to the Superintendent or by<br />

the Superintendent to the President of the Association. This request shall be submitted on or<br />

before the 120th calendar day prior to the expiration of this Contract, and negotiations shall<br />

start on or before the 90th calendar day prior to the expiration of this Contract.<br />

Notwithstanding any other provision in this Article, the parties may modify the Negotiations<br />

Procedure for the purpose of beginning negotiations earlier by mutual agreement prior to the<br />

commencement of any negotiations provided for in this Agreement.<br />

B. Any subject matter to be considered during negotiations will be specified in writing.<br />

C. The first negotiations session shall be held within fifteen (15) days of the date of the filing date<br />

of the Notice to Negotiate to SERB.<br />

D. At the first negotiations session, both parties shall mutually exchange their fully written<br />

proposals in such language as would be suitable for a final contract. Topical listings by either<br />

party of items proposed for negotiations, i.e. "agenda lists," shall constitute a clear failure of<br />

compliance and may be disregarded. After the first negotiations session, no new proposals may<br />

be introduced during the course of negotiations without the mutual consent of the parties.<br />

E. Representation shall be three (3) representatives each for the <strong>Board</strong> and the Association. Either<br />

team may have a maximum of two (2) nonspeaking observers present at any negotiations<br />

session. Neither party in any negotiations shall have control over the selection of the<br />

negotiating or bargaining representatives of the other party.<br />

F. The parties may call upon additional professional and lay representatives to consider matters<br />

under discussion and to make suggestions necessary. Clerical assistance may be provided at<br />

the cost agreeable to both parties. The cost of such consultants shall be borne by the party<br />

requesting their services.<br />

G. Relevant data and supporting information, proposals and counterproposals will be presented.<br />

H. All negotiations shall be conducted in closed session.<br />

I. During the period of negotiations, interim reports of progress may be made to the Association<br />

by its Negotiations Committee and to the <strong>Board</strong> by the Superintendent and/or the representative<br />

<strong>Board</strong> member. However, while negotiations are in process, both negotiation teams shall<br />

approve any release to news media.<br />

J. Prior to the end of any negotiations meeting, there shall be agreement to the time, place, and<br />

date of the subsequent meeting until negotiations are completed.<br />

K. Upon the request of either party, the negotiations meeting shall be recessed to permit the<br />

requesting party a reasonable time to caucus. Caucuses shall not exceed thirty (30) minutes,<br />

unless extended by mutual agreement. Separate caucus rooms and copy equipment will be<br />

provided.<br />
