406 TRANSFER, VACANCY, AND PROMOTIONS (P.N. 2009)<br />

A. Vacancy<br />

Vacancies in positions covered in this Contract shall be posted on faculty bulletin boards in<br />

each building within five (5) days after each regular or special <strong>Board</strong> meeting during the<br />

regular school year. During the summer months, said notice shall be mailed to the Association<br />

President and to the teachers who have given previous written notice of interest to available<br />

positions.<br />

B. Voluntary Transfer or Promotion<br />

1. This Section is primarily to set forth procedures whereby teachers can make known their<br />

desire and be considered for a new assignment. Employed teachers properly<br />

certificated/licensed can make known their interest in changing positions opened through<br />

vacancy or creation by the <strong>Board</strong> as made known to teachers in 406/A, above. Teachers<br />

may also request a change in position annually, by completing the letter of intent<br />

distributed by the Superintendent to all teachers by April 1. If said vacancy occurs,<br />

requesting teachers shall receive written notification of the disposition of said opening.<br />

Teachers must be or will be properly certificated/licensed by the effective date of the<br />

position considered.<br />

2. No position shall be filled until five (5) days after posting on bulletin boards or in<br />

summer months (except August) seven (7) days after the date of postmark to the<br />

Association President.<br />

C. Involuntary Transfer<br />

1. Teacher placement is recognized as a responsibility of the Superintendent. In order to<br />

meet educational needs of the District, it may be necessary to involuntarily transfer a<br />

teacher. An involuntary transfer shall mean a change in the teacher's assignment without<br />

the teacher's consent. Involuntary transfer shall be limited to once per school year,<br />

except for transfers due to the fact that the teacher being transferred again is the only<br />

teacher certified/licensed for the position. An involuntary transfer shall be effected only<br />

after the teacher involved is given a two (2) week written notice as to the reasons for said<br />

transfer. The teacher may request in writing a meeting with the Superintendent to discuss<br />

the merits of the transfer. The teacher may at his/her option have a representative of<br />

his/her choice at this meeting. Such a transfer shall be made only when the<br />

Superintendent determines it is the best interest of the educational program. No teacher<br />

shall be transferred to a position for which he/she does not hold standard<br />

certification/licensure.<br />

2. A teacher who is involuntarily transferred to a different grade level or to a subject matter<br />

in which the teacher has not taught for the past three (3) years, upon request will receive<br />

support from a Mentor Teacher and/or the Curriculum Coordinator.<br />

3. A teacher (excluding a special area teacher) who is involuntarily transferred out of his/her<br />

content area/and or grade level and other than for a RIF shall be provided a stipend of<br />

Two Hundred Fifty Dollars ($250.00) for the time necessary to prepare for the new<br />

assignment.<br />

4. If no equitable solution can be reached, the transferred teacher shall have the option to<br />

request release from his/her contract and said request will be granted. The teacher also<br />
