3. If the teacher receives medical attention and/or is absent from his/her assigned duties<br />
more than three (3) days, a certificate from a licensed physician, stating the nature of the<br />
disability and its duration, may be required before Assault Leave payment is made.<br />
4. A teacher shall not qualify for payment of used Assault Leave until he/she has completed<br />
the leave form (Appendix D).<br />
5. Said teacher shall not be permitted to accrue Assault Leave.<br />
6. Payment for Assault Leave shall be at the assault teacher's rate of pay in effect at the time<br />
of the assault or the rate for which the member may become eligible in accordance with<br />
the Ohio Revised Code.<br />
7. Payment shall be discontinued when the teacher elects to retire or is no longer under<br />
contract with the <strong>Board</strong>.<br />
8. Falsification of either a signed statement or a physician's certificate is reason for<br />
suspension or termination of employment under ORC 3319.16.<br />
512 UNPAID SABBATICAL LEAVE (P.N. 1986)<br />
Any member of the bargaining unit may apply for a Sabbatical Leave of absence without pay for any<br />
period up to one (1) school year in duration for the purpose of continuing his/her education through<br />
college, other schooling, travel, grants, VISTA, Peace Corps, other governmental service, or overseas<br />
teaching. Persons wishing to apply for such a leave shall submit application to the Superintendent<br />
outlining the parameters, purpose, how leave will benefit the teacher and the District, and expected<br />
professional growth, etc., of the leave, and leave dates including the expected date of return. The<br />
Superintendent will in turn submit the application and accompanying particulars to the Sabbatical<br />
Leave Committee comprised of two (2) persons selected by the Association and two (2) persons<br />
selected by the <strong>Board</strong>. Said Committee will expeditiously review the application and make<br />
recommendation to the Superintendent with rationale for the recommendation. The final decision<br />
rests with the <strong>Board</strong>.<br />
513 UNPAID SHORT TERM LEAVE (P.N. 1991)<br />
Teachers may take unpaid short term leave for periods not to exceed three (3) school days per year<br />
with a ten (10) day prior notice to the Superintendent and Principal. Teachers should avoid using this<br />
leave contiguous with Thanksgiving, Christmas, and/or Spring Break, etc.<br />
514 FAMILY AND MEDICAL LEAVE ACT (FMLA) (P.N. 2012)<br />
A. An eligible employee may take up to twelve (12) workweeks of unpaid leave (“FMLA<br />
Leave”) in any school year (August 1 through July 31) for one (1) or more of the following<br />
circumstances:<br />
1. The birth of an employee’s child and to care for the child up to age one (1);<br />
2. The placement of a child with an employee for adoption or foster care, up to a twelve<br />
(12) month period after the placement;<br />
3. To care for the spouse, child, or parent of an employee when that family member has a<br />
serious health condition (Form WH – 380F);<br />
4. The employee’s inability to perform the functions of the position because of the<br />
employee’s own serious health condition. (Form WH 380E)<br />
