history <strong>of</strong> constitutional reform has always <strong>in</strong>volved constructed<br />
mediations, which regarded, first, <strong>in</strong> <strong>the</strong> case <strong>of</strong> liberal<br />
constitutions, <strong>the</strong> mercantile relations <strong>of</strong> exchange and, later, <strong>in</strong><br />
<strong>the</strong> case <strong>of</strong> welfarist constitutions, a dialectic between capital and<br />
labor. It is difficult to imag<strong>in</strong>e today what mediations could be<br />
constructed regard<strong>in</strong>g <strong>the</strong> processes <strong>of</strong> f<strong>in</strong>ancialization that live<br />
at <strong>the</strong> heart <strong>of</strong> <strong>the</strong> contemporary' economy. Categories such as<br />
representation and democracy, let alone national sovereignty,<br />
cannot be redef<strong>in</strong>ed without recogniz<strong>in</strong>g that global f<strong>in</strong>ancial<br />
markets have become <strong>the</strong> preem<strong>in</strong>ent seat <strong>of</strong> <strong>the</strong> autonomous<br />
production <strong>of</strong> legality and politics. The command exercised by<br />
f<strong>in</strong>ance tends <strong>in</strong>creas<strong>in</strong>gly to leap over <strong>the</strong> <strong>in</strong>stitutional<br />
mediations <strong>of</strong> <strong>the</strong> nation-states and impose a k<strong>in</strong>d <strong>of</strong> blackmail<br />
by which not only employment and salaries but also <strong>the</strong><br />
enjoyment <strong>of</strong> basic rights (from hous<strong>in</strong>g to health) depend<br />
<strong>in</strong>eluctablv on <strong>the</strong> dynamics and fluctuations <strong>of</strong> f<strong>in</strong>ancial<br />
markets.<br />
And yet, <strong>in</strong> this situation, numerous political struggles,<br />
especially <strong>the</strong> encampments <strong>of</strong> 2011, have put forward new<br />
pr<strong>in</strong>ciples that have great constitutional relevance. They have<br />
made <strong>of</strong> <strong>the</strong>se pr<strong>in</strong>ciples a new common sense and designated<br />
<strong>the</strong>m as <strong>the</strong> basis <strong>of</strong> a project <strong>of</strong> constituent action. Believ<strong>in</strong>g that<br />
only a constituent process based <strong>in</strong> <strong>the</strong> common can provide a<br />
real alternative, we thus hold <strong>the</strong>se truths to be self-evident, that<br />
all people are equal, that <strong>the</strong>y have acquired through political<br />
struggle certa<strong>in</strong> <strong>in</strong>alienable rights, that among <strong>the</strong>se are not only<br />
life, liberty', and <strong>the</strong> pursuit <strong>of</strong> happ<strong>in</strong>ess but also free access to<br />
<strong>the</strong> common, equality <strong>in</strong> <strong>the</strong> distribution <strong>of</strong> wealth, and <strong>the</strong><br />
susta<strong>in</strong>ability <strong>of</strong> <strong>the</strong> common. It is equally evident that to secure<br />
<strong>the</strong>se rights, democratic governance must be <strong>in</strong>stituted, deriv<strong>in</strong>g<br />
its just powers from <strong>the</strong> participation <strong>of</strong> <strong>the</strong> governed and <strong>the</strong><br />
transparency <strong>of</strong> governmental organization. It is evident, f<strong>in</strong>ally,<br />
that whenever any form <strong>of</strong> government becomes destructive <strong>of</strong><br />
<strong>the</strong>se ends, it is <strong>the</strong> right <strong>of</strong> <strong>the</strong> people to alter or to abolish it and<br />
to <strong>in</strong>stitute new government, lay<strong>in</strong>g its foundation on such<br />
pr<strong>in</strong>ciples and organiz<strong>in</strong>g its powers <strong>in</strong> such form as to <strong>the</strong>m shall<br />
seem most likely to affect <strong>the</strong>ir safety and happ<strong>in</strong>ess.
