CARRIED UNANIMOUSLY 11.3 DEVELOPMENT APPLICATION 15/2007 - BUILDING SETBACK VARIATION 77 (LOT 115) P 1089 HUGHES STREET - D AND M ROCK Author Manager Regulatory Services Disclosure of Any Interest Nil. Précis D and M Rock, 77 Hughes Street, Denham, have submitted Development Application 15/2007 which requests Council approval to construct a free standing carport within the front setback of 77 (Lot 115) Hughes Street, Denham. While a carport, with Council approval, can be permitted within a front setback location, this particular application seeks to infill the southern facing wall of the carport which identifies it as a pseudo garage, which is contrary to the Residential Design Codes. This report considers variable circumstances which may allow Council to grant conditional approval to this application. Background
ORDINARY COUNCIL AGENDA - 30 MAY 2007 Page 25 Comment When considering variables to primary street setbacks the most important criteria for assessment relates to - * Visual impact on the streetscape. * Possible impact on adjoining properties. * Evaluation of each application based upon the merits or otherwise of each individual application to avoid setting unwarranted precedents. While this application, because of its brick southern wall, has to be assessed as a garage and is therefore contrary to the Residential Design Codes, its location in Hughes Street has an exceptionally wide road reserve. The lot has a frontage of 28.0 metres and the dwelling is double storey, hence the impacts of this proposal could be considered as complimentary to the streetscape, with no impact on adjoining properties and with the merit of providing screening for the occupant's vehicles. However I believe that if this proposal/application is approved it should be conditional upon streetscape values being preserved or enhanced. This could be achieved by having the southern brick wall a mix of construction materials rather than face brickwork. Legal Implications Shire of Shark Bay Town Planning Scheme No 2 (as amended). Strategic Implications Careful consideration of streetscape values have important long term economic benefits for the community.
