Section 10.6<br />

Request for Vacation<br />

In order to assure the orderly performance and continuity of services provided by<br />

the employees in their department, each employee wishing to schedule a vacation<br />

should request such vacation leave as far in advance as reasonably possible. Requests<br />

for vacation shall not arbitrarily be denied by the Employer. The Employer shall respond<br />

within five (5) work days to such requests.<br />

Section 10.7 Scheduling Vacations<br />

Vacations will be chosen on a rotating schedule where the employee with the most<br />

seniority will be given first choice of one block of vacation and so on down the list of<br />

employees. Only one block of vacation time may be taken then it will go on to the<br />

next employee. (A block of vacation time is defined as one (1) day to fifteen (15) consecutive<br />

days of vacation.) After all employees have been given the chance to chose a<br />

vacation time, then it will start over at the top of the seniority list.<br />

After May 1st, if an employee has any remaining vacation time, vacations will be<br />

scheduled on the basis of first requested, first granted. If two (2) or more employees<br />

seek the same vacation period and neither employee has yet been granted the vacation,<br />

then seniority shall control the award of such vacation.<br />

Section 10.8 Vacation Canceling and Rescheduling<br />

In the case of an emergency as determined by the Employer, the Employer may<br />

cancel and reschedule any or all approved vacation leaves in advance. In the case of<br />

an emergency, the Employer will, wherever possible and practical, attempt to recall<br />

employees from vacations in the reverse order of granting vacations. In the event of<br />

any cancellation, the rescheduling of vacation time shall be accomplished on a first requested,<br />

first granted basis, except that if two (2) or more employees seek the same vacation<br />

period and neither employee has yet been granted the vacation, then seniority<br />

shall control the award of such vacation. In the event of any cancellation, the Employer<br />

shall, upon the submission of proper written documentation, reimburse the employee<br />

for any actual out of pocket expenses incurred by reason of recall from vacation. If an<br />

employee has scheduled days off immediately preceding or following an approved vacation,<br />

he/she shall not be required to work on those days. The provisions of Section<br />

12.10, entitled "Overtime Assignments" do not apply.<br />

Section 10.9 Holidays During Vacation Period<br />

In the event a holiday occurs during the period when an employee is on approved vacation<br />

leave, such holiday shall be considered as a holiday and shall not be counted as<br />

part of the employee's vacation.<br />

Section 10.10 Separation From Employment<br />

Employees are requested to give at least two (2) weeks advance written notice of their<br />

intention to resign to the Employer. If an employee is deemed to have been voluntarily<br />

terminated pursuant to Section 19.2 of this <strong>Agreement</strong>, or if an employee resigns or<br />

abandons his/her employment without first submitting at least one (1) week's advance<br />
