Section 25.2<br />
Severance Pay<br />
An employee shall be paid for all unused non-sick days accumulated time on the<br />
books as of the date of his/her resignation or retirement, including all holdover days<br />
resulting from the beginning of the payroll period.<br />
Section 25.3 Reassignment<br />
If the Employer assigns an employees to a classification higher than a deputy clerk<br />
wage and then reassigns the employee to a deputy clerk position, said employee will<br />
be paid the hourly rate at which the deputy clerk left. However, all increases that were<br />
bargained for will apply.<br />
Section 25.4 Job Classification Study<br />
Commencing with the 2012 calendar year, the Employer agrees to conduct a Job<br />
Classification Study for the position of Deputy <strong>Clerk</strong>. The study shall be done by the<br />
County Human Resources Department and is to be completed no later than June 30,<br />
2012. Should a determination be made by the Study that the Deputy <strong>Clerk</strong> position<br />
should be adjusted, the Employer shall make every reasonable attempt to implement<br />
the adjustment no later than September 30, <strong>2013</strong>, however, the implementation of an<br />
adjustment shall be non-binding on the Employer.<br />
ARTICLE XXVI<br />
NO STRIKE OR LOCKOUT<br />
Section 26.1 No Lockout<br />
No lockout of employees shall be instituted by the Employer during the term of<br />
this <strong>Agreement</strong>.<br />
Section 26.2 No Strike<br />
During the term of this <strong>Agreement</strong>, there shall be no strikes, concerted stoppages<br />
of work, concerted mass absenteeism, or any other slow downs. Any or all employees<br />
who violate any of the provisions of this Section may be discharged or otherwise disciplined.<br />
The failure to confer a penalty in any instance is not a wavier of such right<br />
in any other instance nor is it a precedent.<br />
Section 26.3 Union Official Responsibility<br />
Each employee who holds the position of officer or steward or committee person<br />
of the local Union occupies a position of special trust and responsibility in maintaining<br />
and bringing about compliance with the provisions of this Article. In the event of a violation<br />
of Section 26.2, the Union agrees to inform its members of their obligations<br />
under this <strong>Agreement</strong> and to direct them to return to work.<br />
