written notice to the Employer, then unless otherwise agreed in a particular instance<br />

by the Employer, the employee shall not be entitled to any pay for accumulated vacation<br />

time. Except as otherwise provided herein, an employee shall receive pro rata paid vacation<br />

benefits based upon the number of months actually worked upon termination of<br />

employment.<br />

Section 10.11 Accumulation<br />

If because of operating needs the Employer cannot grant an employee's request<br />

for vacation time within the twelve-month period after the expiration of the calendar<br />

year such time was earned, such vacation time may be accumulated for an additional<br />

twelve-month period. In any event, upon request, vacation time must be scheduled so<br />

that it may be taken no later than twelve months after the expiration of the calendar<br />

year in which such vacation time was earned. If an employee does not request and<br />

take accrued vacation within such period, such vacation shall be lost.<br />

Section 10.12 Payment on Death of Employee<br />

Upon the death of an employee, the Employer shall pay to the legal representative<br />

of the Estate an amount equal to the vacation benefit due.<br />

ARTICLE XI<br />

HOLIDAYS<br />

Section 11.1 Holidays Observed<br />

All eligible employees shall have time off, with full salary payment, for the holidays<br />

or days designated as Court holidays by the Chief Judge of the 17th Judicial <strong>Circuit</strong><br />

in the annual administrative order.<br />

Section 11.2 Holiday Eligibility Pay<br />

To be eligible for holiday pay the employee shall work the employee's last work<br />

day before the holiday and first scheduled work day after the holiday or the day taken<br />

as the holiday if the employee works on the holiday, unless absence on any of these<br />

work days is for good cause and approved by the Employer. An employee on a leave<br />

of absence or on unpaid status is not eligible for holiday pay.<br />

Section 11.3 Advance Notice<br />

Employees scheduled to work a holiday shall be given as much advance notice as<br />

practicable.<br />

Section 11.4 Holiday Pay<br />

Employees who do not work on a holiday shall receive holiday pay computed at<br />

the regular straight time hourly rate for the number of hours for which they are normally,<br />

regularly scheduled to work immediately prior to the holiday. Holidays shall<br />

accrue in accordance with the following:<br />
