shall be at the discretion of the Employer. If compensatory time is to be taken, it shall<br />

be at a time convenient to the employee(s) and consistent with the operating needs of<br />

the Employer. Employees may not use compensatory time off which they have not<br />

previously accrued. Compensatory time shall be taken under this Article as required<br />

by the Fair Labor Standards Act if such continues to be applicable to local government<br />

employees.<br />

Section 12.5 Lunch Period<br />

Work schedules shall provide for the work day to be broken at approximately midpoint<br />

by a meal period of not less than thirty (30) minutes and not more than sixty (60)<br />

minutes.<br />

Employees who receive an unpaid lunch period and are required to work at their<br />

work assignments during such period and who are not relieved, shall have such time<br />

treated as hours worked for purposes of computing overtime and shall be paid in wages<br />

or compensatory time off, at the Employer’s discretion, at the appropriate straight or<br />

overtime rate, whichever may be applicable.<br />

Employees shall have the right to leave their work site during their lunch period.<br />

Section 12.6 Rest Periods<br />

There shall be two (2) rest periods of fifteen (15) minutes each during each regular<br />

shift; one during the first half of the shift and one during the second half of the shift.<br />

Section 12.7 Call Back Pay<br />

Any employee called back to work outside of his/her regularly scheduled shift or<br />

on a scheduled day off shall be paid a minimum to two (2) hours pay at the applicable<br />

rate from the time the employee is called. Work schedules will not be changed because<br />

of call back time in order to avoid overtime or straight time pay.<br />

Section 12.8 Changes In Normal Work Day and Work Week<br />

The shifts, work days and hours to which employees are assigned shall be posted<br />

on relevant bulletin boards. Should programmatic or operational needs require a change<br />

in employee work schedules, notice of such schedule change shall be given to the affected<br />

employee(s) and the Union as far in advance as is reasonably practicable. Upon<br />

request, the Employer will meet and confer with the affected employee(s) and the Union<br />

to explore alternatives to the proposed change prior to implementation.<br />

Disputes over such changes being made shall be subject to the grievance procedure.<br />

Temporary schedule changes may be implemented pending final resolution of the<br />

above-referenced dispute(s).<br />

Section 12.9 No Pyramiding<br />

Compensation shall not be paid (or compensatory time taken) more than once for<br />

the same hours under any provisions of this Article or <strong>Agreement</strong>.<br />
