Use of proscribed drugs as well as being under the influence of alcohol during<br />

working hours shall be cause for discipline, including discharge; alternatively, the Employer<br />

shall if practicable, provide the employee with an opportunity to participate in<br />

a drug rehabilitation program.<br />

Section 24.10 Employee Assistance Program<br />

1. That the Employer may implement an Employee Assistance Plan (EAP) applicable<br />

to the bargaining unit employees at any time, now or in the future.<br />

2. That the cost of an EAP implemented by the Employer shall be borne exclusively<br />

by the Employer.<br />

3. Following the date the Employer first implements an EAP, pursuant to this<br />

Section, the Employer shall retain the right to change the EAP provider, or<br />

otherwise change the provisions of the EAP, so long as the basic level of benefits<br />

available to the Employee under the EAP remain substantially the same.<br />

4. That notwithstanding any provision of this <strong>Agreement</strong> the Employer retains<br />

the unqualified right to terminate and discontinue an EAP with thirty (30) days<br />

advance written notice to the Union President.<br />

5. That an Employee's participation in an EAP shall not be construed as a limitation<br />

on the Employer’s right to discipline the Employee in accordance with<br />

the terms of the collective bargaining agreement between the Employer and<br />

the Union.<br />

Section 24.11 Collective Bargaining <strong>Agreement</strong> to be Provided<br />

to New Employee<br />

Upon successful completion of the appropriate probationary period as provided<br />

for in Section 1.2, each employee shall be provided with a copy of the Collective Bargaining<br />

<strong>Agreement</strong> by the Employer.<br />

Section 24.12 Union Orientation<br />

The Union shall be allowed orientation for new hires up to one (1) hour with pay.<br />

ARTICLE XXV<br />

WAGES AND OTHER PAY WAGES PROVISIONS<br />

Section 25.1 Wages<br />

1. The base wage plan is outlined in Appendix A .<br />

2. Longevity: Effective October 1, 2005, and each year thereafter, all employees<br />

who have completed three (3) or more years of service shall receive a one<br />

(1%) percent increase in their regular hourly rate of pay on their anniversary<br />

date: provided, however, that such increases relating to the first year of this<br />

<strong>Agreement</strong> shall be implemented on April 2, 2006. These increases shall be<br />

in addition to any general increase in regular hourly rates of pay agreed to by<br />

the Union and the Employer.<br />
