RO. In this respect, the Code uses wording such as “by the competent authority, or by arecognized organization duly authorized for this purpose”.Most of the tasks related to flag State inspection <strong>and</strong> certification under theMLC, 2006 can be undertaken by an RO. When an RO is appointed, the flag State (or itscompetent authority) needs to specify the scope of the RO’s role with respect toverification of national requirements. Although the attention of an RO carrying out a flagState inspection might be drawn to a possible deficiency on a ship by seafarers <strong>and</strong>reported to the flag State, the investigation of complaints that are made to the flag Stateregarding its ships (St<strong>and</strong>ard A5.1.4, paragraph 5) or the enforcement of the nationalrequirements implementing the MLC, 2006 should be dealt with by the competentauthority in each flag State. Information as to the role of ROs <strong>and</strong> the scope of theirauthority should also be made available to seafarers in the event that they have acomplaint.C5.1.g. Must all ships be inspected?All ships covered by the MLC, 2006 [see B4. What ships does the MLC, 2006 applyto?], are subject to inspection for all the requirements of the <strong>Convention</strong> (Regulation 5.1.4,paragraph 1). For ships that will be certified the provisions of Regulation 5.1.3 <strong>and</strong>St<strong>and</strong>ard A5.1.3 will also apply. The inspection st<strong>and</strong>ards are the national requirementsimplementing the MLC, 2006.C5.1.h. What is the list of 14 areas to be certified?St<strong>and</strong>ard A5.1.3, paragraph 1 provides that:A list of 14 areas in the working <strong>and</strong> living conditions of seafarers that must be inspected<strong>and</strong> certified as complying with the national laws <strong>and</strong> regulations or other measuresimplementing the requirements of the MLC, 2006 is contained in Appendix A5-I to the<strong>Convention</strong>. Must all ships be certified under Regulation 5.1.3?Under Regulation 5.1.3, certification is m<strong>and</strong>atory for ships of:— 500 gross tonnage or over, engaged in international voyages; <strong>and</strong>— 500 gross tonnage or over, flying the flag of a Member <strong>and</strong> operating from a port, orbetween ports, in another country.For the purpose of this Regulation, “international voyage” means a voyage from acountry to a port outside such a country.Certification would not therefore be m<strong>and</strong>atory for a ship under 500 gross tonnage,even if engaged in international voyages or for a ship of 500 gross tonnage or more if itflies the flag of the flag State concerned <strong>and</strong> is not engaged in international voyages.Regulation 5.1.3, paragraph 2 allows a shipowner whose ship does not fall under them<strong>and</strong>atory certification provisions to request that the ship be certified after the inspection.C5.1.k. How detailed should Part I of the declaration of maritime labour compliance (DMLC)be?The main requirements for Part I of the DMLC are set out in St<strong>and</strong>ard A5.1.3,paragraphs 9 <strong>and</strong> 10 of the MLC, 2006:It must be drawn up by the competent authority [see A25. Who is the competentauthority?] in the form corresponding to the model in Appendix A5-II. It must:(i)(ii)identify the list of matters to be inspected in accordance with the MLC, 2006 (i.e., the14 areas listed in Appendix A5-I);identify, in each of those areas, the national requirements embodying the relevantprovisions of the <strong>Convention</strong> by providing a reference to the relevant national legalprovisions as well as, to the extent necessary, concise information on the main content ofthe national requirements;(iii) refer to ship-type specific requirements under national legislation;(iv) record any substantially equivalent provisions [see A11.
