36 FOURTH ANNUAL REPORT OF NATIONAL LABOR RELATIONS BOARDUnfair labor practice cases pending as of June 30, 1939.—At theend of the fiscal year covered by this report there were pending beforethe <strong>Board</strong> 2,902 unfair labor practice cases, involving 926,169 workers.R large majority of the cases, 1,701, were pending in the regional officeswhere investigations were being carried on to determine whetheror not the facts in the charge constituted unfair labor practices withinthe meaning of the act. In 169 cases, complaints had been 'authorizedbut were still awaiting formal issuance. Complaints had been issuedin'88 cases and these cases were awaiting the commencement of hearings.Hearings were in progress in 33 cases, and, in 179 cases, hearingshad been completed but the parties were awaiting the issuance ofintermediate reports. In 401 cases, intermediate reports had beenissued ; these cases were awaiting decision by the <strong>Board</strong>. In 331 casesthe <strong>Board</strong> was awaiting compliance with its orders.Formal action in unfair labor practice cases.—During the year, the<strong>Board</strong> instituted formal action in a relatively small proportion of theunfair labor practice cases on the docket. As pointed out previously,complaints were issued in 522 cases. Hearings were concluded in 424cases, such hearings being conducted by trial examiners designatedby the Chief Trial Examiner. Some of these cases heard were latersettled, withdrawn, or dismissed before the issuance of an intermediatereport by the trial examiner. The trial examiners issued intermediatereports in 371 cases. In 9 cases, they dismissed the entirecomplaint ; 5 in 26 cases, compliance with their reports was secured.Upon the filing of exceptions to the intermediate report by either ofthe parties to the proceedings the unfair labor practice case is automaticallytransferred to the <strong>Board</strong>. If no exceptions are filed and ifthere is no compliance with the intermediate report within 10 daysafter issuance, the case is transferred to the <strong>Board</strong>.° During the entirefiscal year, 397 unfair labor practice cases were transferred to the<strong>Board</strong> either upon exceptions filed to the intermediate report or uponthe failure of respondents to comply with the recommendations of thetrial examiners. In addition, 191 cases were transferred to the <strong>Board</strong>upon the issuance of <strong>Board</strong> orders to that effect.The <strong>Board</strong> issued decisions in 381 unfair labor practice cases or 5.5percent of all cases either awaiting decision on July 1, 1938, or filedduring the subsequent 12 months. Of these 381 decisions, a total of 149decisions were issued on the basis of a stipulation entered into by theinterested parties.A summary of the formal action taken by the <strong>Board</strong> during theyear broken down by the regions in which such unfair labor practicecases were filed is presented in table IX.5 It should be noted that frequently the trial examiner dismisses part of the complaint.°Under the revised Rules end Re
