<strong>Employment</strong> <strong>Policies</strong> <strong>Manual</strong> 736.4 Family Medical Leave Act (FMLA)I. OBJECTIVEIt is the policy of the <strong>County</strong> to comply with the U.S. Departmentof Labor Family and Medical Leave Act (FMLA) regulations. The<strong>County</strong> is committed to ensuring that all “eligible employees” aregranted up to twelve (12) workweeks (480 hours) of job protectedleave during a 12-month period for any FMLA qualifying reason. Inaddition, eligible employees may be granted additional leave for acovered service member with a serious injury or illness.II.DIRECTIVESA. The term “eligible employee” means an employee who has beenemployed with the <strong>County</strong> at least twelve (12) months or fiftytwo(52) weeks which need not be continuous and worked atleast 1,250 hours during the previous 12-month period.B. The term “job protected leave” means that upon an employee’sreturn from FMLA leave, he/she will be reinstated to the sameor an equivalent job with the same pay, benefits and terms andconditions of employment.C. The term “parent” means the biological parent of an employeeor an individual who stood in place of a parent to an employeewhen the employee was a son or daughter.D. The term “son” or “daughter” means a biological, adopted,or foster child, a stepchild, a legal ward, or a child of a personstanding in loco parentis, who is under eighteen (18) years ofage, or eighteen (18) years of age or older and incapable of selfcarebecause of a mental or physical disability.
