Civil <strong>Law</strong> 99Some <strong>of</strong> the provisions <strong>of</strong> the Bill were borrowedfrom the enactments which were to be repealed. Butthe Bill was based ma<strong>in</strong>ly on the English law <strong>of</strong> realproperty. <strong>The</strong> <strong>Law</strong> <strong>of</strong> Conveyanc<strong>in</strong>g <strong>and</strong> PropertyAct, 1881, 71 had been enacted <strong>in</strong> Engl<strong>and</strong> before theBill was passed <strong>in</strong>to law <strong>and</strong> some <strong>of</strong> the provisions<strong>of</strong> the <strong>India</strong>n Act notably the provisions relat<strong>in</strong>g tosale by court <strong>of</strong> property free from <strong>in</strong>cumbrance, 72the right to redeem separately or simultaneously, 73<strong>and</strong> the power <strong>of</strong> sale without the <strong>in</strong>tervention <strong>of</strong> thecourt 74 were borrowed from that statute. In fram<strong>in</strong>gthe sections relat<strong>in</strong>g to the law <strong>of</strong> mortgages <strong>of</strong> immovableproperty <strong>and</strong> charges, assistance was takenfrom the work <strong>of</strong> Dr. Rashbehary Ghose, a dist<strong>in</strong>guishedwriter on the law <strong>of</strong> mortgages <strong>in</strong> <strong>India</strong>. 75At the suggestion <strong>of</strong> Sir Henry Ma<strong>in</strong>e, who was astrong advocate <strong>of</strong> the Cont<strong>in</strong>ental system <strong>of</strong> a publictransfer <strong>of</strong> l<strong>and</strong>, the Act made written <strong>and</strong> registered<strong>in</strong>struments obligatory <strong>in</strong> certa<strong>in</strong> cases <strong>of</strong> sales, mortgages,leases, exchanges <strong>and</strong> gifts <strong>of</strong> immovableproperty. 76<strong>The</strong> Succession Act <strong>and</strong> the Contract Act hav<strong>in</strong>gbeen put on the Statute Book, the chief purpose <strong>of</strong>this Act was to br<strong>in</strong>g the rules which regulated thetransmission <strong>of</strong> property between liv<strong>in</strong>g persons <strong>in</strong>toharmony with the rules effect<strong>in</strong>g its devolution <strong>and</strong>thus to furnish as it were a complement to the work" 44 & 45 Viet. o. 41.
