60 <strong>The</strong> <strong>Common</strong> <strong>Law</strong> <strong>in</strong> <strong>India</strong>recognised the right to a fishery <strong>in</strong> a tidal <strong>and</strong> navigableriver <strong>in</strong> Bengal. 83 As <strong>in</strong>stances <strong>of</strong> other <strong>India</strong>ncommon law rights may be mentioned the right <strong>of</strong>burial <strong>and</strong> with it the right to perform all customaryrites, the right to worship <strong>in</strong> a mosque or temple <strong>and</strong>the right to take out religious processions. 8 * <strong>The</strong><strong>India</strong>n courts have also recognised as a common lawright a right to have access to courts <strong>of</strong> law if aperson can show a cause <strong>of</strong> action. 85VII.CONCLUSIONWe have exam<strong>in</strong>ed the factors which led to theapplication <strong>and</strong> growth <strong>of</strong> the English law <strong>in</strong> <strong>India</strong>.It was almost directly <strong>in</strong>troduced <strong>in</strong> the PresidencyTowns <strong>of</strong> Calcutta, Madras <strong>and</strong> Bombay. In thegreater part <strong>of</strong> the country it obta<strong>in</strong>ed its sway <strong>in</strong>the guise <strong>of</strong> the pr<strong>in</strong>ciples <strong>of</strong> " equity, justice <strong>and</strong>good conscience." <strong>The</strong>n followed the regulationsmade <strong>in</strong> the Prov<strong>in</strong>ces from time to time, <strong>and</strong> themagnificent structure <strong>of</strong> the <strong>India</strong>n Codes erected <strong>in</strong>the latter half <strong>of</strong> the n<strong>in</strong>eteenth century. <strong>The</strong> Codesembodied <strong>in</strong> the ma<strong>in</strong> the pr<strong>in</strong>ciples <strong>of</strong> English lawsimplified <strong>and</strong> modified to suit <strong>India</strong>n conditions.Some <strong>of</strong> the <strong>India</strong>n statutes made express provisionfor the application <strong>in</strong> <strong>India</strong> <strong>of</strong> pr<strong>in</strong>ciples <strong>and</strong> rulesenforced by the English courts for the time be<strong>in</strong>g. 86A prolific source <strong>of</strong> the <strong>in</strong>corporation <strong>of</strong> English83 Sirnath v.
